1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) 4 Teaching License of ) DEFAULT ORDER OF g FRED CHARLES HORN g DENIAL OF LICENSURE 7 8 On October 15, 2002, the Teacher Standards and Practices Commission issued a 9 Notice of Opportunity for Hearing to Fred Charles Horn, in which the Commission proposed to 10 deny issuance of a Teaching License under ORS 342.143. The Notice was sent via U.S. First 11 Class Mail and U.S. Certified Mail Receipt #7001 0320 0005 0740 6090 to the address 12 Mr. Horn provided to the Commission on his application for licensure. The notice sent via 13 U.S. First Class Mail was returned to the Commission "unclaimed" on November 7, 2002. 14 The Notice of Opportunity for Hearing, signed by Victoria Chamberlain, Executive Director, stated: 16 If a request for hearing Is not received within this 21-day period, your right to 17 hearing shaII be considered waived unless your failure to request a hearing was 18 beyond your reasonable control. If you do not request a hearing or if you fail to 19 appear at a hearing, the Commission will uphold the denial of your application for 20 an Oregon teaching license. i; Based on the foregoing, the Commission finds Fred Charles Horn in default and such 23 . default is hereby entered. Based on the records and files 0t the Commission, the Commission 24 enters the following findings of fact, conclusions of law and order. 25 /// 26 /// 27 /// PAGE 1 ~ DEFAULT ORDER OF DENIAL OF LICENSURE~FRED CHARLES HORN .1 FINDINGS 0F FACT 2 1. Mr. Horn held a Basic License with the Commission from July 1, 1975 to June 30, 3 1978. 4 2. On or about May 14, 2002, Mr. Horn submitted an AppIication For Educator License 5 Form C-1 requesting reinstatement of an expired Basic Teacher license. 6 3. Mr. Horn served as a licensed teacher for Ridgefield School District, Ridgefield, 7 Washington beginning in September of 1976. 8 4. On or about May 21, 2001, Mr. Horn resigned from an educational position while 9 under investigation for creating an intimidating, hostile or offensive educational environment at 10 View Ridge Middle School in the Ridgefield School District. Mr. Horn responded affirmatively to 11 character questions. 12 5. At View Ridge Middle School Mr. Horn patted female students on the back and rear 3 end. Mr. Horn made unwelcome and inappropriate comments about female student's Q appearance, put his arms around several female students and put his hands on shoulders or 15 backs in ways that made them feel uncomfortable. Mr. Horn made inappropriate and 16 unprofessional comments to female students “What are you doing tonight?" or calling a female 17 student “Hottie” or “Hot Stuff," using inappropriate juvenile nicknames some of which have 18 inappropriate sexual connotations. 19 6. Mr. Horn failed to furnish evidence satisfactory to the Commission to establish his 20 fitness to serve as an educator. 21 CONCLUSIONS OF LAW 22 The behavior Mr. Horn demonstrated as a teacher at View Ridge Middle School in the 23 Ridgefield School District is evidence that he lacks fitness as an educator pursuant to OAR 584- 24 050-0006(5). Mr. Horn's refusal to participate in a sexual harassment training program to 25 modify his behavior is further evidence of lack of fitness to serve as an educator pursuant to O PAGE 2 ~ DEFAULT ORDER OF DENIAL OF LICENSURE-—FRED CHARLES HORN '1 OAR 584—050-0006(5).
