, 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION é OF THE STATE OF OREGON g In the Matter of the Teaching License of ) 6 ) STIPULATION OF FACTS 7 JEFFREY MARK LONGMORE ) AND PROBATION g ) 10 On or about July 18, 2001, the Teacher Standards and Practices Commission 11 (Commission) received an application for a Transitional Teaching License from Jeffrey 12 Mark Longmore (Longmore). 13 Mr. Longmore responded “yes” to character question, “1. Have you ever left any 14 educational or school-related employment, voluntarily or involuntarily, while the subject 15 of an inquiry, review or investigation of alleged misconduct or alleged violation of ‘16 professional standards of conduct or when you had reason to believe such investigation 17 was imminent? 18 Mr. Longmore responded “yes” to character question, “2. Are you currently the subject 19 of an inquiry, review or investigation for alleged misconduct or alleged violation of 20 professional standards of conduct?” Mr. Longmore responded "yes" to character 21 question, “3. Have you ever failed to complete a contract for educational services in 22 any educational or school-related position, or for any alleged misconduct or alleged 23 violation of professional standards of conduct been placed on leave by your employer or 24 left such employment prior to the end of the contract term?” Mr. Longmore responded 25 “yes” to character question, “8. Have you ever been convicted or been granted l 26 conditional discharge by any court for: (a) any felony; (b) misdemeanor; or (c) any major i 27 traffic violation..., “ Mr. Longmore also responded “yes” to character question, “10. Have Page 1 STIPULATION OF FACTS AND PROBATION _ SHEETS . 1 you ever entered a plea of guilty or No Contest relative to any charge for an offense 2 listed in question 8.?" Mr. Longmore provided information from Trempealeau County 3 Circuit Court, Wisconsin that he pled no contest to Disorderly Conduct (Class A 4 misdemeanor) and was convicted on April 3, 2001. 5 After review of the facts in this matter, Mr. Longmore and the Executive Director 6 agree that their respective interests, together with the public interests, are best served 7 by a stipulation to certain facts, followed by a probation of two (2) years. 8 This Order sets forth the facts upon which the parties have agreed and the 9 sanction to be imposed. In entering into this stipulation, Mr. Longmore waives the right 10 to a hearing t0 contest the findings of fact, conclusion of law and order set forth below. 11 Mr. Longmore understands that the Commission will impose a two (2) year probation 12 with specific conditions. '13 This stipulation is contingent upon approval and adoption of the Order by the 14 Commission. lfthe Commission does not adopt this Order, neither Mr. Longmore nor 15 the Commission are bound by these Stipulations and Mr. Longmore retains all rights to 16 a hearing on the allegations. 17 STIPULATION OF FACTS 18 1. On or about July 18, 2001, The Commission received an application for a 19 Transitional Teaching License from Jeffrey Longmore. 20 2. Mr. Longmore holds a Wisconsin Teaching License valid July 1, 1997 to June 30, 21 2002. He is currently the subject of an investigation by the Wisconsin Teacher 22 Education and Licensing Teams, Professional Practices/Discipline section. .23 / / / Page 2 STIPULATION OF FACTS AND PROBATION ‘ 1 3. On or about May 15, 2000, Mr. Longmore chaperoned a senior class picnic in ‘ 2 Trempealeau, Wisconsin. As a result of an altercation involving a student Mr. 3 Longmore was arrested for Disorderly Conduct 4 4. On April 3, 2001, Mr. Longmore pled No Contest and was convicted of Disorderly 5 Conduct in Trempealeau County Circuit Court. The Court sentenced Mr. Longmore 6 to 12 days in jail and fined him $1315.00. 7 5. Mr. Longmore has no prior or subsequent criminal convictions. 8 IT IS S STIPULATED: 9 agréflaéw 44-4-1‘ O 1? Myton, Execu ve Director Date '14 CONCLUSION OF LAW 15 Conviction for a misdemeanor crime may be used as evidence to establish an 16 applicants lack of fitness to serve as a teacher under ORS 342.143. 17 ORDER 18 The Commission adopts the above Findings of Fact and places Mr. Longmore on 19 probation with the Commission for two (2) years. 20 The Commission authorizes issuance of a Transitional Teaching License to 21 Jeffrey Mark Longmore subject to all standard terms and conditions and subject to the 22 following special terms of probation: 23 1. The Commission places Mr. Longmore on a two (2) year probation to commence 24 September 14, 2001. .25 2. The probation shall remain in effect subject to the following conditions: Page 3 STIPULATION OF FACTS AND PROBATION 1 a. Mr. Longmore shall report in writing within ten days to the Executive Director . 2 of the Commission any arrest or citation for any felony, misdemeanor, major 3 traffic violation; 4 b.
