' 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) ‘ 1’ 4 Teaching License of ) STIPULATION OF FACTS, .\ , 5 MIKE WILSON BRYANT ) ORDER OF REPRIMANDf ./ .q t 6 DOB/SQW'ZZTQW ) AND PROBATION a; " \ 7 On August 30, 2001, the Teacher Standards and Practices Commission, 1?“ 8 (Commission) informed Mike Wilson Bryant that the Commission had sufficient-X ‘ I‘) V ~~ 9 evidence to charge him with knowing misrepresentation directly related to his July 3,5; 10 2001, Application for Educator License Form C-1 with the Commission. 11 Mr. Bryant fully cooperated with the Commission‘s investigation. After review of 12 the matters alleged, Mr. Bryant and the Commission agree that their respective 13 interests, together with the public interest, are best served by a stipulation to certain '14 facts, the imposition of a Public Reprimand and a one (1) year probation. This Order 15 sets forth the facts upon which the parties have agreed and the sanction to be imposed. 16 ln entering into this stipulation, Mr. Bryant waives the right to a hearing to contest the i 17 findings of fact, conclusion of law and order set forth below. 18 STIPULATION OF FACTS 19 1. On or about July 3, 2001, Mr. Bryant signed and submitted an Application for 20 Educator License Form C-1 for a Transitional Teaching License. Mr. Bryant responded 21 “no” to all character questions including, “9. Have you ever been arrested or cited for 22 any offense listed in question (8) above which is still pending in the court?” 23 2. On or about July 20, 2001, the Commission received a response from the FBI 24 indicating that Mr. Bryant was arrested for Driving Under the Influence if Liquor in .25 Arizona on May 7, 1999. On or about August 30, 2001, Mr. Bryant admitted to TSPC that a charge of . 2 Driving Underthe Influence of Liquor is still pending in an Arizona Court. 3 4. Mr. Bryant accepts responsibility for making a false statement on his 4 Application for Educator License Form C-1 for a Transitional Teaching License 5 acknowledges his behavior was inappropriate 6 This stipulation is contingent upon approval and adoption of the Order by the 7 Commission. Myton Executiv Director Date 17 Teacher Standards and Practices Commission 18 CONCLUSION OF LAW 19 Mr. Bryant violated OAR 584-020-0040(4)(c) when he failed to disclose to the 20 Commission that he had been arrested for a misdemeanor crime that was still pending 21 in the court. 22 ORDER 23 The Commission adopts the above Findings of Fact and imposes a Public 24 Reprimand for knowing misrepresentation directly related to licensure on Mr. Bryant. 25 This Order shall serve as the Public Reprimand. O Page 2 STIPULATION OF FACTS , ORDER OF REPRIMAND AND PROBATION - BRYANT 1 The Commission authorizes issuance of a Transitional Teaching License to Mike ' 2 Wilson Bryant subject to any endorsements or authorizations thereon and subject to the 3 following special terms of probation: 4 1. The Commission places Mr. Bryant on a one (1) year probation to commence 5 on August 30, 2001. 6 2. The probation shall remain in effect subject to the following conditions: 7 a. Mr. Bryant shall conduct himself as a law-abiding citizen; 8 b. Mr. Bryant shall report in writing within ten days to the Executive Director 9 of the Commission and arrest or citation for and felony, misdemeanor or 10 major traffic violation; and 11 c. Mr. Bryant shall comply with Standards for Competent and Ethical 12 Performance of Oregon Educators under OAR Chapter 584, Division 020.
