Ms. Huff reported criminal convictions on the character question section of 1O Application for Educator License Form C-1. Ms. Huff provided Judgment Orders for ' 11 convictions of Theft on August 20, 1993, in Malheur County Circuit Court and March 2, 12 1995, in Polk County Circuit Court. 13 After review of the facts in this matter, Ms. Huff and the Executive Director agree that their respective interests, together with the public interests, are best served by a 15 stipulation to certain facts and the issuance of Iicensure subject to a three (3) year 16 probation. 17 This Order sets forth the facts upon which the parties have agreed and the 18 sanction to be imposed. In entering into this stipulation, Ms. Huff waives the right to a 19 hearing to contest the findings of fact, conclusion of law and order set forth below. 20 Ms. Huff understands that the Commission will impose a three (3) year probation with 21 specific conditions. 22 This stipulation is contingent upon approval and adoption of the Order by the 23 Commission. If the Commission does not adopt this Order, neither Ms. Huff nor the 24 Commission are bound by these Stipulations and Ms. Huff retains all rights to a hearing 5 on the allegations. On or about July 29, 2002, the Commission received a complete application 3 for an Initial Teaching License from Dawn Marie Huff. 4 2. On August 20, 1993, Ms. Huff was convicted of Theft III in the District Court 5 of the State of Oregon for the County of Malheur. 6 3. On March 2, 1995, Ms. Huff was convicted of Theft I (reduced to a 7 misdemeanor) in the Circuit Court of the State of Oregon for Polk County. The court 8 sentenced Ms. Huff to eighteen (18) months probation; 80 hours of community service; 9 and ordered her to pay $473.33 in restitution. 1O 4. Ms. Huff accepts responsibility for her behavior and acknowledges her 1 1 behavior was inappropriate. Conviction of a crime may be used as evidence to 23 establish an applicant's lack of fitness to serve as an educator pursuant to ORS 24 342.143. ' /// Page 2 STIPULATION OF FACTS AND PROBATION - HUFF .1 ORDER 2 The Commission adopts the above Stipulation of Facts and authorizes the 3 issuance of a Initial Teaching License to Dawn Marie Huff subject to all standard terms 4 and conditions. 5 Furthermore, the Commission imposes a three (3) year probation to commence 6 on October 11, 2002, subject to the following special terms: 7 1. Ms. Huff shall conduct herself as a law-abiding citizen; 8 2. Ms. Huff shall report in writing within ten days to the Executive Director of the 9 Commission any arrest or citation for any felony, misdemeanor, major traffic 10 violation; 11 3.
