8 On or about April 4, 2009, the Teacher Standards and Practices Commission received a
9 report from Central Linn School District Superintendent Ed Curtis indicating that Mr. Ellis may
10 have engaged in conduct constituting gross neglect of duty. —'
11 After review of the matters alleged, Mr. Ellis and the Commission agree that their
12 respective interests, together with the public interest, are best served by a stipulation to certain
‘ 13 facts and a 30-day suspension of his Initial l Teaching License.
‘ 14 By signing below, Mr. Ellis acknowledges, understands, stipulates, and agrees to the
15 following: (i) he has been fully advised of his rights to notice and a hearing to contest the
16 ﬁndings of fact, conclusions of law, and order set forth below, and fully and finally waives all
17 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final
18 Order of Suspension(Stipulation and Final Order); (ii) this Stipulation and Final Order is a public
19 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and
20 Final Order is contingent upon and subject to approval and adoption by the Commission. If the
21 Commission does not approve and adopt this Stipulation and Final Order, then neither Mr. Ellis
‘ 22 nor the Commission are bound by the terms herein; (iv) he has fully read this Stipulation and
23 Final Order, and understands it completely; (v) he voluntarily, without any force or duress,
24 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated
25 Final Order below; (vi) he states that no promises or representation have been made to induce
26 him to sign this Stipulation and Final Order; and (vii) he has consulted with an attorney
27 regarding this Stipulation and Final Order and has been fully advised with regard to his rights

3 STIPULATION OF FACTS
4 1. Mr. Ellis has been licensed by TSPC since October 28, 2003. He currently holds an
5 Initial l Teaching License with an Endorsement in Social Studies that was issued on May 26,
6 2009 and expires on May 25, 2012.
7 2. Prior to the 2006-2007 school year, Mr. Ellis submitted a resume to the Central Linn
i 8 School District. His resume stated that his teaching license included endorseTnents in
9 Language Arts and Social Studies, when his license only included an endorsement in Social
‘ 1O Studies.

19 CONCLUSIONS OF LAW
20 Mr. Ellis‘ conduct described in paragraph 2 above is a violation of ORS 342.175(1)(b),
21 OAR 584-020-0040(4)(n) as it incorporates 584-020-0010(5)(Use professional Judgment), OAR
22 584-020-0040(4)(o) as incorporates OAR 584-020-0035(2)(a)(App/y for, accept, offer, orassign
23 a position of responsibility only on the basis of professional qualifications, and will adhere to the
24 conditions of a contract or the terms of the appointment) OAR 584-020-0040(4)(c)(Knowing
25 falsification of any document or knowing misrepresentation directly related to licensure,
26 employment, orprofessional duties).

1 The Commission has the authority to impose discipline in this matter under ORS
2 342.120 through 342.430 and OAR Chapter 584.
3 FINAL ORDER
4 The Commission adopts and incorporates herein the above findings of facts and
5 conclusions of law and hereby suspends Mr. Ellis's Initial I Teaching License 30 days from the
6 date of this Order. l. .
