OF THE STATE OF OREGON 1 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 ANGELA DENISE DAHLIN ) AND PROBATION 6 On March 30, 2005, the Teacher Standards and Practices Commission (Commission) 7 received a report from Don Grotting, Superintendent, Nyssa Public Schools alleging that Angela 8 Denise Dahlin (Dahlin) failed to maintain a professional relationship with a student. On 9 November 3, 2005, the Commission took action to charge Ms. Dahlin and on December 30, 10 2005, issued Ms. Dahlin a Notice of Opportunity for Hearing. On January 18, 2006, Ms. Dahlin 11 requested a hearing on the proposed action of the Commission. 12 After review of the matters alleged, Ms. Dahlin and the Commission agree that their 13 respective interests, together with the public interest, are best served by a stipulation to certain 14 facts, the imposition of a Public Reprimand followed by a three (3) year Probation. . This document sets forth the facts upon which the parties have agreed and the 16 stipulated sanction to be imposed. Ms. Dahlin stipulates that there is sufficient evidence in the 17 Commission’s files and records to support the findings of fact, conclusions of law, and order set 18 forth below. 19 By signing below, Ms. Dahlin acknowledges, understands, stipulates, and agrees to the 20 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 21 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 22 such rights and any rights to appeal or othenlvise challenge this Stipulation of Facts, Order of 23 Reprimand and Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is a 24 public document and disclosed to the public upon request by the Commission; (iii) this 25 Stipulation and Final Order is contingent upon and subject to approval and adoption by the 26 Commission. lf the Commission does not approve and adopt this Stipulation and Final Order, ' then neither Ms. Dahlin nor the Commission are bound by the terms herein; (iv) she has fully Page 1 - STIPULATION OF FACTS, FINAL ORDER OF REPRIMAND AND PROBATION - DAHLIN 1 read this Stipulation and Final Order, and understands it completely; (v) she voluntarily, without a any force or duress, enters into this Stipulation and Final Order and consents to issuance and 3 entry of the Stipulated Final Order below; (vi) she states that no promises or representation has 4 been made to induce her to sign this Stipulation and Final Order; and (vii) she has consulted 5 with an attorney regarding this Stipulation and Final Order and has been fully advised with 6 regard to her rights thereto, or waives any and all rights to consult with an attorney prior to 7 entering into this Stipulation and Final Order and issuance and entry of the Stipulated Final 8 Order below. 9 STIPULATION OF FACTS 10 1. Ms. Dahlin has been licensed by the Commission since November 20, 2002. Ms. 11 Dahlin currently holds an Initial Teaching License issued January 31, 2005, valid until 12 September 12, 2008, with a Language Arts endorsement. 13 2. Ms. Dahlin has been employed by the Nyssa School District from October of 2002 to ‘l the present. 15 3. During the 2002-2003 school year, Ms. Dahlin failed to maintain professional teacher 16 student boundaries. 17 IT IS SO STIPULATED AND AGREED TO: 18 WM 0121 0Z2 19 Ange Denise Dahlin Date 20 t ~ 21 l @Zéé M24 MW 22 Victoria rlain, Executive Director Date 23 Teacher Standards and Practices Commission 24 CONCLUSIONS OF LAW 25 Ms. Dahlin’s failure to maintain professional teacher student boundaries is in violation of 26 OAR 584-020-0040(4)(o), as it incorporates OAR 584-020-0035(1)(c). This misconduct 27 constitutes Gross Neglect of Duty. The Commission's authority to impose discipline in this ' matter is based upon ORS 342.175. Page 2 - STIPULATION OF FACTS, FINAL ORDER OF REPRIMAND AND PROBATION - DAHLIN 1 FINAL ORDER Q The Commission hereby adopts and incorporates herein the above findings of fact and I 3 imposes a Public Reprimand on Angela Denise Dahlin. This Order shall serve as the Public 4 Reprimand. 5 Furthermore, the Commission places Ms. Dahlin on Probation for a period of three (3) ‘ 6 years from the date of this order subject to the following special terms and conditions of 7 probation: 8 1. Ms. Dahlin shall participate in a Commission approved boundaries training program, 9 consisting of eight (8) one hour sessions, and successfully complete said program within the 10 first year of the probation period and report in writing to the Executive Director; 11 2. Ms. Dahlin shall report to the Commission her compliance with the terms of probation 12 every six (6) months during her probation, on or before: May 2, 2007; November 2, 2007; 13 May 2, 2008; November 2, 2008; May 2, 2009; and November 2, 2009. . 3. Ms. Dahlin shall notify the Commission of any discipline imposed upon her by an 15 employing school district for any reason during the term of this probation; 16 4. Ms. Dahlin shall report in writing within ten days to the Executive Director of the 17 Commission any arrest or citation for any felony, misdemeanor, or major traffic violation; and 18 5.
