5 MONICA LYNN SHEAFFER ) OF REPRIMAND
6 On or about May 12, 2006, the Teacher Standards and Practices Commission (Commission)
7 received a completed Student Teaching or Practicum Form PA-1, from Monica Lynn Sheaffer wherein
8 she failed to fully disclose past criminal convictions.
9 Ms. Sheaffer fully cooperated with the Commission's investigation. After a review of the
10 matters alleged, Ms. Sheaffer and the Commission agree that their respective interests, together with
11 the public interest, are best served by a stipulation to certain facts and the imposition of a public
1 2 reprimand.
13 This document sets forth the facts upon which the parties have agreed and the stipulated
14 sanction to be imposed. Ms. Sheaffer stipulates that there is sufficient evidence in the Commission's
15 files and records to support the findings of fact, conclusions of law, and order set forth below.
16 By signing below, Ms. Sheaffer acknowledges, understands, stipulates, and agrees to the
17 following: (i) she has been fully advised of her rights to notice and a hearing to contest the findings of
18 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any
19 rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand
20 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to
21 the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon
22 and subject to approval and adoption by the Commission. If the Commission does not approve and
23 adopt this Stipulation and Final Order, then neither Ms. Sheaffer nor the Commission are bound by
24 the terms herein; (iv) she has fully read this Stipulation and Final Order, and understands it
25 completely; (v) she voluntarily, without any force or duress, enters into this Stipulation and Final Order
26 and consents to issuance and entry of the Stipulated Final Order below; (vi) she states that no
27 promises or representation has been made to induce her to sign this Stipulation and Final Order; and
28 (vii) she has consulted with an attorney regarding this Stipulation and Final Order and has been fully

1 advised with regard to her rights thereto, or waives any and all rights to consult with an attorney prior
2 to entering into this Stipulation and Final Order. This Order sets forth the facts upon which the parties
3 have agreed and the sanction to be imposed. Ms. Sheaffer stipulates that there are sufficient facts
4 contained in the Commission’s files and records to support the findings of fact and conclusions of law
5 set forth below. In entering into this stipulation, Ms. Sheaffer waives the right to a hearing to contest
6 the findings of fact, conclusion of law and order set forth below.
7 STIPULATION OF FACTS
8 1. On or about May 12, 2006 Ms. Shaeffer signed and submitted a Student Teaching or
9 Practicum Form PA-1. Ms. Shaffer failed to disclose all past criminal convictions.
10 2. Ms. Shaeffer did not disclose a 1991 conviction for interfering with a police officer, nor did
11 she disclose a 2001 conviction for fourth degree assault.
12 3. Ms. Shaeffer did disclose a September 18, 2008 conviction for Unlawfully Obtaining Public
13 Assistance and Unlawfully Obtaining and Using Food Stamps.

21 CONCLUSIONS OF LAW
22 Monica Lynn Sheaffer failed to disclose her past criminal convictions on her application for
23 licensure. This conduct constitutes Gross Neglect of Duty in violation of OAR 584-020-0040(4)(c)
24 (Knowing falsification of any document or knowing misrepresentation directly related to licensure,
25 employment, or professional duties). Ms. Sheaffer was convicted of Unlawfully Obtaining Public
26 Assitance and Unlawfully Obtaining Obtaining and Using Food Stamps. This conduct constitutes
27 Gross Unfitness in violation of ORS 411.630, ORS 411840 and OAR 584-020-0040(5)(c) (Conviction
28 of violating any federal, state, 0r local law. A conviction includes any final judgment of conviction by a
29 court whether as the result of guilty plea, no contest plea or any other means.) The Commission has

1 the authority to impose discipline in this matter under ORS 342.120 through 342.430 and OAR
2 Chapter 584.
3 FINAL ORDER
4 The Commission hereby adopts and incorporates herein the above findings of fact and
5 conclusions of law and hereby imposes a Public Reprimand on the licensure of Monica Sheaffer. This
6 order shall serve as the Public Reprimand.
