1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Licensure of ) AND 5 SALLY J. STORM ) FINAL ORDER OF REPRIMAND 6 On October 12, 2007, the Chair of the McKenzie School District submitted a letter to the 7 Teacher Standards and Practices Commission (Commission) explaining that Sally Storm had 8 begun her duties as Superintendent of the district without proper Iicensure. 9 Dr. Storm fully cooperated with the Commission's investigation. After review of the 10 matters alleged, Dr. Storm and the Executive Director agree that their respective interests, 11 together with the public interest, are best sewed by a stipulation to certain facts and a public 12 reprimand. 13 This document sets forth the facts upon which the parties have agreed and the 14 stipulated sanction to be imposed. Dr. Storm stipulates that there is sufficient evidence in the 15 Commission's files and records to support the findings of fact, conclusions of law, and order set 16 forth below. 17 By signing below, Dr. Storm acknowledges, understands, stipulates, and agrees to the 18 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 19 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 20 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 21 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 22 document and disclosed to the public by the Commission upon request; (iii) this Stipulation and 23 Final Order is contingent upon and subject to approval and adoption by the Commission. If the 24 Commission does not approve and adopt this Stipulation and Final Order, then neither Dr. 25 Storm nor the Commission are bound by the terms herein; (iv) she has fully read this Stipulation 26 and Final Order, and understands it completely; (v) she voluntarily, without any force or duress, 27 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND-STORM 1 Final Order below; (vi) she states that no promises or representations have been made to 2 induce her to sign this Stipulation and Final Order; and (vii) she has consulted with an attorney 3 regarding this Stipulation and Final Order and has been fully advised with regard to her rights 4 thereto, or waives any and all rights to consult with an attorney prior to entering into this 5 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 6 STIPULATION OF FACTS 7 1. Dr. Storm currently holds a Transitional Administrative License that was issued by the 8 Commission on October 17, 2007. The license is valid through October 17, 2010. . 9 2. Prior to accepting the position of Superintendent, McKenzie School District, Dr. Storm 10 was a licensed school administrator in the State of Washington. 11 3. Upon accepting the position of McKenzie School District Superintendent, Dr. Storm 12 made prompt inquiry regarding the process necessary to obtain Oregon Iicensure. 13 4. Dr. Storm mistakenly believed that her application for Oregon licensure would be 14 timely if made within six months from commencing service in Oregon. 15 5. Dr. Storm learned on October 11, 2007 that she was required to obtain an Oregon 16 license before acting as an administrator in Oregon. On October 12, 2007, the McKenzie 17 School District requested that the commission issue an expedited Emergency Administrative 18 License. Dr. Storm immediately sought and secured the documents and supporting materials 19 required for her application which were provided to the Commission between October 11 and 20 October 15, 2007. 21 6. This conduct constitutes Gross Neglect of Duty.
