1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) REVOCATION OF LICENSE 6 GREGORY ROGER HUBER-MAYO'ITE ) AND RIGHT TO APPLY 7 8 On June 6, 2011, the Teacher Standards and Practices Commission (Commission) issued 9 a Notice of Opportunity for Hearing to Gregory Roger Huber-Mayotte (Huber-Mayotte) in 10 which the Commission charged him with Gross Neglect of Duty pursuant to ORS 342.175(1)(b); l 1 OAR 584-020-oo4o(4)(n), OAR 584-020-0010(5), OAR 584-020-oo4o(4)(0), OAR 584-020- 12 0035(3)(a), and gross unfitness in violation of OAR 584-020-0040(5)(c), and OAR 584-020- 13 0040(5)(e). The Notice was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7010 14 0290 0001 6831 3612 t0 the address on file with the Commission. Huber-Mayotte signed for the 15 Certified Mail on June 15, 2011. The Notice of Opportunity of Hearing, dated June 6, 2011, and 16 signed by Victoria Chamberlain, Executive Director, stated: 17 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD, 18 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR 19 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. 20 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A 21 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY 22 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER 23 DISCIPLINE.” 24 25 Huber-Mayotte did not request a hearing. The Commission, therefore, finds Huber-Mayotte t0 26 be in default and enters the following findings of fact, conclusions of law and order, based on the 27 files and records of the Commission concerning this matter. 28 FINDINGS OF FACT 29 1. Huber-Mayotte has been licensed as a teacher in Oregon since September 2, 2009. His 30 current Initial I Teaching License, with endorsements in Basic Mathematics (HS, ML), 31 General Business (HS, ML), Integrated Science (HS, ML), and Multiple Subjects (MIDLVL), ' 32 issued on September 2, 2009, is valid until March 24, 2013. During all relevant times, 33 Huber-Mayotte’s employment status was unknown and he is not believed to be employed by 34 any Oregon school district. On February 16, 2011, Huber-Mayotte was convicted of Criminal Mistreatment-l (ORS 2 163.205), a Class C Felony, and Aggravated Theft in the 1st Degree (ORS 164.057), a Class B 3 Felony 4 3. The conduct leading t0 Huber-Mayotte’s conviction was that Huber-Mayotte defrauded 5 approximately $182,000 from his elderly mother. Huber-Mayotte’s conduct further led to 6 his mother being removed from his home for her own care and protection. 7 CONCLUSIONS OF LAW 8 Gregory Roger Huber-Mayotte’s conduct described in #2 above constitutes Gross 9 Neglect of Duty in violation of ORS 342.175(1)(b); OAR 584-020-004o(4)(n) as it incorporates 10 OAR 584-020-0010(5) (Use professional judgment); OAR 584-020-0040(4)(o) as it 1 1 incorporates OAR 584-020-0035(3)(a) (Maintain the dignity of the profession by respecting 12 and obeying the law, exemplifying personal integrity and honesty). This conduct also 13 constitutes Gross Unfitness in violation of ORS 342.175(1)(c); OAR 584-020-oo4o(5)(c) 14 (Conviction of violating any federal, state, or local law.
