1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) REVOCATION OF RIGHT TO 6 DONAVON EARL HAMPTON ) APPLY FOR LICENSURE 7 8 On March 18, 2010, the Teacher Standards and Practices Commission 9 (Commission) issued a Notice of Opportunity for Hearing to Donavon Earl Hampton ‘ 10 (Hampton) in which the Commission charged him with Gross Neglect of Duty pursuant 11 to OAR 584-020-0040(4)(c). The Notice was sent via U.S. First Class Mail and U.S. 12 Certified Mail Receipt 7009 1410 0002 1925 4591 to the address on file with the 13 Commission. Mr. Hampton signed for the Notice on March 19, 2010. The Notice of 14 Opportunity of Hearing, dated March 18, 2010, and signed by Victoria Chamberlain, 15 Executive Director, stated: 16 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY 17 PERIOD, YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED 18 UNLESS YOUR FAILURE TO REQUEST A HEARING WAS BEYOND YOUR 19 REASONABLE CONTROL. IF YOU DO NOT REQUEST A HEARING OR IF 20 YOU FAIL TO APPEAR AT A HEARING, THE COMMISSION WILL ADOPT AN 21 ORDER OF DEFAULT WHICH MAY INCLUDE THE REVOCATION OR 22 SUSPENSION OF YOUR LICENSE OR OTHER DISCIPLINE." 23 24 Mr. Hampton did not request a hearing. The Commission, therefore, finds Mr. Hampton 25 to be in default and enters the following findings of fact, conclusions of law and order, 26 based on the files and records of the Commission concerning this matter. 27 FINDINGS OF FACT 28 1. M. Hampton held an Oregon Basic Teaching License from July 27, 1987, through 29 October 28, 1995. Mr. Hampton was licensed as a substitute teacher from May 30 19, 2004, until October 28, 2007. During this time period he submitted an 31 Application for Educator License, Form C-1 on the dates of July 27, 1987, 32 October 28, 1991, and April 19, 2004. Although he replied, “Yes” to question 8, 2 he only reported a 1968 arrest for DUll. A review of criminal history checks by 3 the State Department of Education shows that he had a September 1971 4 conviction for “Drunk” (in a public place) and "lndecent Exposure" (To Minors and 5 Adults), which he failed to disclose. He admitted to having been arrested and 6 pleading no contest to these charges in September 1971. 7 8 CONCLUSIONS OF LAW 9 Donovan Earl Hampton's failure to report these convictions in response to 10 question 8 constitutes gross neglect of duty under ORS 342.175(1)(b) as it relates to 11 OAR 584-020-0040(4)(c) (Knowing falsification of any document or knowing 12 misrepresentation direct/y related to licensure, employment, or professional duties.)
