.1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS. 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 STACI JO CLADOUHOS ) AND PROBATION 6 On May 2, 2005, the Teacher Standards and Practices Commission (Commission) 7 received a report from Jody Fischer, Director of Personnel, Woodburn Schools, indicating that 8 Staci Jo Cladouhos (Cladouhos) may have violated standards while proctoring a CIM test. 9 Ms. Cladouhos fully cooperated with the Commission's investigation. After review of the 10 matters alleged, Ms. Cladouhos and the Commission agree that their respective interests, 11 together with the public interest, are best served by a stipulation to certain facts, the imposition 12 of a public reprimand followed by a two (2) year probation. 13 This document sets forth the facts upon which the parties have agreed and the stipulated sanction to be imposed. Ms. Cladouhos stipulates that there is sufficient evidence in ‘5 the Commission's files and records to support the findings of fact, conclusions of law, and order 16 set forth below. 17 By signing below, Ms. Cladouhos acknowledges, understands, stipulates, and agrees to 18 the following: (i) she has been fully advised of her rights to notice and a hearing to contest the 19 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 2O such rights and any rights to appeal or otherwise challenge this Stipulation of Facts, Final Order 21 of Reprimand and Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is 22 a public document and disclosed to the public upon request by the Commission; (iii) this 23 Stipulation and Final Order is contingent upon and subject to approval and adoption by the 24 Commission. If the Commission does not approve and adopt this Stipulation and Final Order, 25 then neither Ms. Cladouhos nor the Commission are bound by the terms herein; (iv) she has fully read this Stipulation and Final Order, and understands it completely; (v) she voluntarily, ‘ i without any force or duress, enters into this Stipulation and Final Order and consents to Page 1 - STIPULATION OF FACTS, FINAL ORDER OF REPRIMAND AND PROBATION - CLADOUHOS .1 issuance and entry of the Stipulatecl Final Order below; (vi) She states that no promises or 2 representation has been made to induce her to sign this Stipulation and Final Order; and (vii) 3 she has consulted with an attorney regarding this Stipulation and Final Order and has been fully 4 advised with regard to her rights thereto, or waives any and all rights to consult with an attorney 5 prior to entering into this Stipulation and Final Order and issuance and entry of the Stipulated 6 Final Order below. This Order sets forth the facts upon which the parties have agreed and the 7 sanction to be imposed. Ms. Cladouhos stipulates that there are sufficient facts contained in the 8 Commission’s files and records to support the findings of fact and conclusions of law set forth 9 below. In entering into this stipulation, Ms. Cladouhos waives the right to a hearing to contest 10 the findings of fact, conclusion of law and order set forth below. Ms. Cladouhos understands 11 that the probation will be subject to specific terms and conditions. 12 STIPULATION 0F FACTS e 1. Ms. Cladouhos has been licensed by the Commission since February 11, 2000. .4 Ms. Cladouhos currently holds an Initial Teaching License valid February 7, 2003, through 15 January 26, 2007, with a Basic Mathematics endorsement. 16 2. Ms. Cladouhos completed a teacher education program at Pacific University in 17 December of 1999. Ms. Cladouhos served as a high school math teacher for South Umpqua 18 School District during the 2002-2003 school year. Ms. Cladouhos served as a high school math 19 teacher for the North Marion School District for the 2003-2004 school year. 2O 3. Ms. Cladouhos began her assignment as a high school math teacher for the 21 Woodburn School District on August 30, 2004. On March 31, 2005, at the request of the 22 District, Ms. Cladouhos signed a resignation agreement effective June 21, 2005 (the last 23 contract day). 1 24 4. On or about April 13, 2005, while proctoring a CIM test, Ms. Cladouhos provided 65 assistance to students with test questions, allowed students to receive answers from other Page 2 - STIPULATION OF FACTs, FINAL ORDER OF REPRIMAND AND PROBATION - CLADOUHOS 1 students and allowed students to walk around the room and view an answer sheet on her desk. .2 Ms. Cladouhos resigned in lieu of termination effective May 19, 2005. 3 Ms. Cladouhos enters into this Stipulation of Facts with the knowledge that the 4 Commission shall place her on probation for a period 0f two (2) years. This Stipulation is 5 contingent upon approval and adoption of the Order by the full Commission. if the Commission 6 does not adopt this Order, neither Ms. Cladouhos nor the Commission are bound by these 7 stipulations and Ms. Cladouhos retains the right to a hearing on the allegations. 8 IT IS SO STIP LATED AND AGREED TO: 9 diag‘ 24 (2M 6'34'JZ 1O Staci Jo Cladouhos Date 11 ‘ _ 12 WM é ~72 7 dé 13 Victoria C lain, Executive Director Date i 14 Teacher Standards and Practices Commission i 5 CONCLUSIONS OF LAW ‘ Q Staci Jo Cladouhos violated OAR 584—020-0040(4)(n) as that rule incorporates OAR 17 584-020-0010(5) when she failed to demonstrate a commitment to use professional judgment 18 while proctoring a CIM test on or about April 13, 2005. This conduct constitutes Gross Neglect 19 of Duty. The Commission's authority to impose discipline in this matter is based upon ORS 20 342.175. 21 / // 22 /// 23 /// O Page a - STIPULATION OF FACTS, FINAL ORDER OF REPRIMAND AND PROBATION . CLADOUHOS 1 FINAL ORDER .2 The Commission adopts and incorporates herein the above finding of facts, conclusions 3 of iaw, and based thereon, hereby imposes a Public Reprimand on Staci Jo Cladouhos.
