STANDARD ) AND REVOCATION OF LICENSE g On or about May 23, 2013, the Teacher Standards and Practices Commission 8 (Commission) received a complaint from the Southern Oregon Education Service District 9 (SOESD), indicating that licensed educator, Eleanor A. Standard (Standard), had committed 1O acts of unprofessional conduct. 1 1 After review of the matters alleged, Standard and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to certain 1 3 facts, Standards surrender of her Oregon educator license and the consequent revocation of 14 Standards licensure. 15 By signing below, Standard acknowledges, understands, stipulates, and agrees to the 16 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 17 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 1 8 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 19 Order of Surrender and Revocation of License (Stipulation and Final Order); (ii) this Stipulation 20 and Final Order is a public document and disclosed t0 the public upon request by the 21 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to approval 22 and adoption by the Commission. If the Commission does not approve and adopt this 23 Stipulation and Final Order, then neither Standard nor the Commission are bound by the terms 24 herein; (iv) she has fully read this Stipulation and Final Order, and understands it completely; 25 (v) she voluntarily, without any force or duress, enters into this Stipulation and Final Order and 26 consents to issuance and entry of the Stipulated Final Order below; (vi) she states that no 27 promises or representation has been made to induce her to sign this Stipulation and Final 28 Order; and (vii) she has consulted with an attorney regarding this Stipulation and Final Order Page 1 STIPULATION OF FACTS AND FINAL ORDER OF SURENDER OF LICENSE AND REVOCATION- ELEANOR A. STANDARD 1 and has been fully advised with regard to her rights thereto, or waives any and all rights to 2 consult with an attorney prior to entering into this Stipulation and Final Order and issuance and 3 entry of the Stipulated Final Order below. 4 This Stipulation and Final Order sets forth the facts upon which the parties have agreed 5 and the sanction to be imposed. Standard stipulates that there are sufficient facts contained in 6 the Commission’s files and records to support the findings of fact and conclusions of law set 7 forth below. In entering into this stipulation, Standard waives the right to a hearing to contest 8 the findings of fact, conclusions of law and order set forth below. 9 STIPULATION OF FACTS 1O 1. The Commission has licensed Standard since July 1, 1972. Standard currently holds a 1 1 Standard Teaching License, with an endorsement in Standard Communications 12 Disorders (018), valid from October 21, 2011, through October 20, 2016. During all 1 3 relevant times, Standard was employed by the Southern Oregon Education Service 14 District (SOESD). 15 On May 23, 2013, the Commission received information from the SOESD indicating 16 Standard may have committed acts which constitute gross neglect 0f duty. SOESD’s 17 report alleged that during the 2012-13 school year Standard’s performance as a Speech 18 and Language Pathologist was deficient. The ESD conducted a review of Standard’s 19 performance and noted several problem areas. 20 The SOESD recommended non-renewal of Standard’s contract, and Standard resigned 21 her employment on March 18, 2013. 22 3. After filling in for Standard’s former position, a Speech and Language Pathologist 23 employed by the SOESD alleged additional deficiencies in Standard’s performance and 24 on May 14, 2013, filed a complaint against Standard with the Oregon Board of Examiners 25 for Speech Language Pathology and Audiology regarding Standard’s performance issues. 26 A subsequent investigation by the Board of Examiners for Speech Language Pathology Page 2 STIPULATION OF FACTS AND FINAL ORDER OF SURENDER OF LICENSE AND REVOCATION-— ELEANOR A. Standard engaged in unprofessional conduct as described in section two (2), 12 and three (3) above. This conduct constitutes Gross Neglect of Duty in violation of ORS 13 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-02o-oo1o(5) (Use 14 professional judgment), OAR 584-020-0015(2)(a) (Use of state and district adopted 15 curriculum and goals), OAR 584-020-0015(2)(e) (Skill in the selection and use of teaching 16 techniques conducive to student learning), OAR 584-020-0020(2)(b) (Skill in the application of 17 assessment data to assist individual student growth), OAR 584-020-0025(2)(e) (Using district 18 lawful and reasonable rules and regulations), and OAR 584-020-003o(2)(b) (Skill in 19 communicating with administrators, students, stafl, parents, and other patrons). The above 20 conduct also constitutes gross unfitness in violation of ORS 342-175(1)(c); OAR 584-020- 21 0040(5) (Gross unfitness is any conduct which renders an educator unqualified to perform his 22 0r her professional responsibilities. Conduct constituting gross unfitness may include conduct 23 occurring outside of school hours or ofl school premises when such conduct bears a 24 demonstrable relationship to the educator's ability to fulfill professional responsibilities 25 effectively). 26 The Commission’s authority to impose discipline in this matter is based upon ORS 27 342.175.
