8 On December 14, 2010, the Teacher Standards and Practices Commission

9 (Commission) issued a Notice of Opportunity for Hearing to John David Adamson
10 (Adamson) in which the Commission charged him with Gross Neglect of Duty pursuant
11 to OAR 584-020-0040(4)(n) as it incorporates OAR 584-050-0010(5), and OAR 584-
12 020-0040(4)(d)_ The Notice was sent via U.S_ First Class Mail and U.S. Certified Mail
13 Receipt 7010 0290 0001 6831 4916 to the address on file with the Commission. The
14 Certified Mail was signed for by John Adamson on December 16, 2010. The Notice of
15 Opportunity of Hearing, dated December 14, 2010, and signed by Victoria Chamberlain,
16 Executive Director, stated:
17 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY
18 PERIOD, YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED
19 UNLESS YOUR FAILURE TO REQUEST A HEARING WAS BEYOND YOUR
20 REASONABLE CONTROL. lF YOU DO NOT REQUEST A HEARING OR lF
21 YOU FAIL TO APPEAR AT A HEARING, THE COMMISSION WILL ADOPT AN
22 ORDER OF DEFAULT WHICH MAY INCLUDE THE REVOCATION OR
23 SUSPENSION OF YOUR LICENSE OR OTHER DISCIPLINE."

25 Adamson did not request a hearing. The Commission, therefore, finds Adamson to be
26 in default and enters the following findings of fact, conclusions of law and order, based
27 on the files and records of the Commission concerning this matter.
28 FINDINGS 0F FACT
29 1. John David Adamson has been licensed as a teacher in Oregon since March 13,
30 1981. His current Substitute Teaching License, issued on November 19, 2008, is
31 valid until November 18, 2011. During all relevant times, Adamson substitute taught
32 at the North Bend School District.

1 2. On May 24, 2009, Adamson became angry with a student who was not complying

2 with his instructions. Adamson pushed the student into a sitting positing outside the

3 classroom. In so doing Adamson shoved the student into the lockers in the hallway.

4 CONCLUSIONS OF LAW

5 John David Adamson’s conduct described in paragraph 2 above constitutes

6 gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it

7 incorporates OAR 584-020-0010(5) (Use professional judgment), OAR 584-020-

8 0025(2)(a) (Establishing and maintaining classroom management that is conducive to

9 learning);and OAR 584-020-0040(4)(d) (Unreasonable physical force against students,
10 fellow employees, or visitors to the school, except as permitted under ORS 339.250).
11 The Commission's authority to impose discipline in this matter is based upon
12 ORS 342.175. i
13 FINAL ORDER
14 The Commission hereby imposes a Public Reprimand on the Iicensure of John '
15 David Adamson.
