_ 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 VALORIE GAYE GREEN ) g On or about June 8, 2009, the Teacher Standards and Practices Commission 8 (Commission) received a report indicating possible inappropriate conduct by Valorie 9 Gaye Green (Green), an educator in the Portland Public Schools. 1O After review of the matters alleged, Green and the Commission agree that their 1 1 respective interests, together with the public interest, are best served by a stipulation to 12 certain facts and the imposition of a Public Reprimand on Green’s Standard Teaching 1 3 License. 14 By signing below, Green acknowledges, understands, stipulates, and agrees to the 1 5 following: (i) she has been fully advised of her rights to notice and a hearing to contest 16 the findings of fact, conclusions of law, and order set forth below, and fully and finally 1 7 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of 18 Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation 19 and Final Order is a public document and disclosed t0 the public upon request to the 2O Commission; (iii) this Stipulation and Final Order is contingent upon and subject to 21 approval and adoption by the Commission. If the Commission does not approve and 22 adopt this Stipulation and Final Order, then neither Green nor the Commission are 23 bound by the terms herein; (iv) she has fully read this Stipulation and Final Order, and 24 understands it completely; (v) she voluntarily, without any force or duress, enters into 25 this Stipulation and Final Order and consents to issuance and entry of the Stipulated 26 Final Order below; (vi) she states that no promise or representation has been made to J 27 induce her to sign this Stipulation and Final Order; and (vii) she has consulted with an 28 attorney regarding this Stipulation and Final Order and has been fully advised with ' Page 1 STIPULATION OF FACTS AND ORDER OF REPRIMAND — GREEN, VALORIE GAYE 1 regard to her rights thereto, or waives any and all rights t0 consult with an attorney prior 2 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated 3 Final Order below. 4 STIPULATION OF FACTS 5 1. The Commission has licensed Green since August 21, 1991. Green currently holds a 6 Standard Teaching License, with a Standard Severely Handicapped Learner 7 endorsement, issued October 22, 2005 and valid until October 21, 2010. Green timely 8 applied for renewal 0f her license. During all relevant times Green was employed as an 9 Autism consultant teacher for Portland Public Schools. 10 2. On or about April 9, 2009, Green intervened in a behavioral problem with an 8 year-old 1 1 special education student. Green had observed the student hit another student, and 12 Green understood, from information provided by the classroom teacher, that the student 1 3 had been hitting others all day. Staff present in the classroom reported that Green pulled 14 the student to a corner of the classroom, grabbed him by the shoulders and yelled at the 15 student for his behavior. Green was described as having a loud, angry and intimidating 16 demeanor during this interaction. Green stated that she used a firm, strong voice with 1 7 the student but denied yelling at or grabbing the student’s shoulders. 18 3.
