The Commission and Mr. Bruce 10 have now reviewed the matters alleged and have agreed that their respective interests, together ll with the public interests, are best served by a stipulation to certain facts and the issuance of a 12 teaching license on a probationary basis, together with a public reprimand. This agreement sets . 13 forth the facts upon which the parties have agreed and the Commission’s order. l4 This stipulation is contingent on approval and adoption of the order by the Commission. 15 If the Commission does not adopt this order, neither Mr. Bruce nor the Commission are bound 16 by any matters herein, and Mr. Bruce will retain all rights to a hearing on the allegations of the l7 notice. l8 STIPULATED FACTS l9 Mr. Bruce and the Commission stipulate as follows: 20 l. On March l3, 2000, Mr. Bruce submitted an application for a teaching license t0 21 the Commission. On December 3, 1999, Mr. Bruce entered a plea of guilty and was convicted of 2 the crime of driving under the influence of intoxicants in South Kern, California Municipal 3 Court. He was placed on probation to the court for a period of three years and ordered to serve 4 two days in custody. Myton Date 1 1 ’ 12 CONCLUSION OF LAW l3 Mr. Bruce was convicted of driving a motor vehicle while under the influence of l4 intoxicants in violation of OAR 584-020-0040(5)(c). 15 QBM l6 The Commission adopts the above findings of fact and orders a public reprimand for 17 conviction of driving under the influence of intoxicants. This order shall serve as the public ‘ 18 reprimand. l9 The Commission authorizes issuance of an Oregon Teaching License to Mr. Bruce and 20 places Mr. Bruce on probation for a period of two years subject to the following conditions: 21 1. Mr. Bruce shall comply with all Standards for Competent and Ethical 22 Performance of Oregon Educators under OAR 584 Division 020. Mr. Bruce shall conduct himself as a law-abiding citizen and shall commit no 2 crimes or major traffic violations. 3 3.
