1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 431 In the Matter of the ) STIPULATION OF FACTS, 5 Teaching License of ) AND FINAL ORDER OF g CAROL L. GRAUER ) REPRIMAND 8 On February 5, 2008, the Teacher Standards and Practices Commission 9 (Commission) received a report from Roy Williams, Superintendent, Sheridan School 10 District indicating that Carol Grauer (Grauer) attended a high school basketball game, as 11 a spectator, under the influence of alcohol. 12 Grauer fully cooperated with the Commission's investigation in this matter. After 13 review of the matters alleged, Grauer and the Commission agree that their respective 14 interests, together with the public interest, are best sewed by a stipulation to certain 15 facts and the imposition of public reprimand. 16 This document sets forth the facts upon which the parties have agreed and the 17 stipulated sanction to be imposed. Grauer stipulates that there is sufficient evidence in 18 the Commission’s files and records to support the findings of fact, conclusions of law, 19 and order set forth below. 20 By signing below, Grauer acknowledges, understands, stipulates, and agrees to 21 the following: (i) she has been fully advised of her rights to notice and a hearing to 22 contest the findings of fact, conclusions of law, and order set forth below, and fully and 23 finally waives all such rights and any rights to appeal or othenivise challenge this 24 Stipulation of Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this 25 Stipulation and Final Order is a public document and disclosed to the public upon 26 request by the Commission; (iii) this Stipulation and Final Order is contingent upon and 27 subject to approval and adoption by the Commission. If the Commission does not 28 approve and adopt this Stipulation and Final Order, then neither Grauer nor the 29 Commission are bound by the terms herein; (iv) she has fully read this Stipulation and Page t of3 - STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - GRAUER i 1 Final Order, and understands it completely; (v) she voluntarily, without any force or 2 duress, enters into this Stipulation and Final Order and consents to issuance and entry 3 of the Stipulated Final Order below; (vi) she states that no promises or representation 4 has been made to induce her to sign this Stipulation and Final Order; and (vii) she has 5 consulted with an attorney regarding this Stipulation and Final Order and has been fully 6 advised with regard to her rights thereto, or waives any and all rights to consult with an 7 attorney prior to entering into this Stipulation and Final Order and issuance and entry of 8 the Stipulated Final Order below. 9 STIPULATION 0F FACTS 10 1. The Commission has licensed Carol Grauer since August 17, 1979. Grauer 11 currently holds a Basic Teaching License valid October 22, 2006, through 12 October 22, 2009, with Basic Physical Education and Basic Health Education 13 endorsements. 14 2. Ms. Grauer was employed by the Sheridan School District as a full time teacher 15 from 1979 until her resignation on December 31, 2008. 16 3. This conduct constitutes gross neglect of duty in violation of 4 OAR 584-020-0040(4)(g).
