l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON 2 In the Matter of the ) 3 Teaching License of ) STIPULATION,“\PUBLIC LORI ELAINE NASH ) REPRIMAND and ORDER 4 ) OF PROBATION '\ 5 On March 19, 1998, the Teacher Standards and Practices ‘ 6 Commission (Commission) issued a Notice of Opportunity for Hearing 7 to Lori Elaine Nash (Ms. Nash). Ms. Nash, through her attorney, ‘ 8 requested a hearing to contest the allegations in the notice. j 9 After a review of the matters alleged, the Commission and Ms. Nash i 10 have agreed that their respective interests and the public j 11 interest are best served by a stipulation to certain facts, and ( 12 the imposition of a public reprimand and order of probation. This 13 agreement sets forth the facts on which the parties have agreed, l4 the sanction to be imposed and the Commission's order. 15 This stipulation and order is subject to review and approval 16 by the full Commission. If the Commission fails to approve the l7 stipulation and proposed order as written, any waiver of rights by 18 Ms. Nash is revoked and any statements contained in this 19 stipulation may not be used by the Commission or Ms. Nash for any 20 reason. 21 STIPULATED FACTS 22 Ms. Nash and the Commission stipulate as follows: 23 1. Ms. Nash holds a basic Oregon teaching license with an 24 endorsement in elementary education. '25 2. On March 29, 1990, Ms. Nash was convicted of the offense 26 of driving under the influence of intoxicants. On August 2, 1994, Ms. Nash was convicted of the offense 4 of driving under the influence of intoxicants. She was sentenced 5 to 3O days in jail, her driving license was suspended, and she was 6 required to undergo alcohol evaluation and treatment. 7 4. On March 2, 1995, Ms. Nash was convicted of driving with 8 a suspended license. 9 5. On June 2, 1995, Ms. Nash was convicted of resisting 10 arrest. She was sentenced to 30 days in jail to be served 11 concurrently with the 30-day jail sentence for her 1994 conviction 12 for driving under the influence of intoxicants. She was also 13 placed under three years of supervised probation. ‘14 6. In October 1996, Ms. Nash's probation officer reported 15 to the court that she had successfully completed the court-imposed 16 alcohol evaluation and treatment program. 17 7. In June 1997, Ms. Nash submitted an application for 18 renewal of her Oregon teaching license. On that application, she 19 failed to disclose her convictions for driving with a suspended 20 license and resisting arrest. Ms. Nash has been convicted of various serious traffic 13 and criminal offenses in violation of OAR 584-020-0040(5)(c). ‘l4 2. Ms. Nash failed to disclose convictions for driving 15 while suspended and resisting arrest on her 1997 application to 16 TSPC in Violation of OAR 584-020-0040(4)(c). 17 ORDER i 18 Based on the foregoing, the Commission imposes a public 19 reprimand, and this order shall serve as the public reprimand. i 20 The Commission further places Ms. Nash on probation for a period 21 of three years from the date of this order. The probation shall 22 be subject to the following conditions: 23 1. Ms. Nash shall report to the executive director of the 24 Commission any change in her address, within 10 days of the 25 change. 26 /// ‘AGE 3 ~ STIPULATION, PUBLIC REPRIMAND S: ORDER OF PROBATION (LORI ELAINE NASH) ' 1 2. For the first 12 months of the probationary period, 2 Ms. Nash shall attend Alcoholics Anonymous meetings on at least a 3 weekly basis. Ms. Nash shall make arrangements with the AA 4 organization to record her attendance at meetings and for the 5 organization to report her attendance, including the dates of 6 attendance, directly to the Executive Director of the Commission, 7 in writing, on a quarterly basis with the first quarterly report 8 to be made not later than January 10, 1999, for the period from 9 the date of this order through December 31, 1998; the second 10 report to be made no later than April 10, 1999, for the period 11 from January 1, 1999 through March 31, 1999; the next report to be 12 made no later than July 10, 1999, for the period from April 1, 13 1999 through June 30, 1999; and the final report to be made no .14 later than October 10, 1999, for the period from July 1, 1999 15 through September 30, 1999. v 16 3. Ms. Nash shall make a written report to the executive 17 director of the Commission on a quarterly basis all of her 18 teaching employment activities in public or private schools in 19 California, Oregon or any other state, listing the name and 20 address of each employer and the dates of employment.
