After review 9 of the matters alleged, Mr. Shull and the Commission agree that their respective interests, together 10 with the public interest, are best served by a stipulation to certain facts and a public reprimand. ll This document sets forth the facts upon which the parties have agreed and the stipulated 12 sanction to be imposed. Mr. Shull stipulates that there is sufficient evidence in the Commission’s files 13 and records to support the findings of fact, conclusions of law, and order set forth below. l4 By signing below, Mr. Shull acknowledges, understands, stipulates, and agrees to the 15 following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings of 16 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any l7 rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand l8 (Stipulation and Final Order), (ii) this Stipulation and Final Order is a public document and disclosed 19 to the public upon request by the Commission, (iii) this Stipulation and Final Order is contingent upon 20 and subject to approval and adoption by the Commission. In entering into this stipulation, 7 Mr. Shull waives the right to a hearing to contest the findings of fact, conclusions of law and order set 8 forth below. 9 STIPULATION OF FACTS lO l. Mr. Shull currently holds a Continuing Administrative License issued 5/22/2008, valid until 1 l 5/21/2013, with Administrator endorsements at all levels. Mr. Shull has served as l 12 Superintendent of the St. Paul School District since July l, 2002. l3 2 While serving as Superintendent of the District in 2007-08, Mr. Shull recommended and the l4 school board approved the hiring of Chris Milliron as a math teacher for St. Paul l-Iigh School 15 on August 8, 2007. The high school principal, Debbie Eder and Supt. Shull discussed during 16 the interview with Chris Milliron the need for him to obtain an emergency teaching license ‘l7 , from 'l‘SPC. l l8 3. Mr. Milliron did not obtain proper licensure. The matter was brought to the attention of Mr. i l9 Shull in August 2008 alter Mr. Milliron learned from TSPC that he was not properly licensed. 20 4. Mr. Shull immediately contacted TSPC to inquire about a corrective course of action for the 2! failure to have Mr. Milliron properly licensed. The corrective action resulted in Mr. Milliron 22 . receiving an expedited license to teach Math. Shull failed to ensure that an educator under his supervision was properly licensed. 9 This conduct constitutes Gross Neglect of Duty in violation of OAR 584~020~0040(4)(n) as it 10 incorporates OAR 584~020~0025(3)(a). FINAL ORDER ll The Commission adopts and incorporates herein the above findings of fact, conclusions of law, l2 and based thereon, imposes a Public Reprimand on Bruce A. Shut].
