7 On October 20, 2014, the Teacher Standards and Practices Commission
8 (Commission) received a report from the Portland Public School District reporting
9 potential professional misconduct on the part of licensed educator, Daniel Barrett
1O Dickason (Dickason).
1 1 After review of the matters alleged, Dickason and the Commission agree that
12 their respective interests, together with the public interest, are best served by a
13 stipulation to certain facts and the imposition of a public reprimand.
14 By signing below, Dickason acknowledges, understands, stipulates, and agrees to
15 the following: (i) he has been fully advised of his rights to notice and a hearing to contest
16 the findings of fact, conclusions of law, and order set forth below, and fully and finally
17 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of
18 Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation
19 and Final Order is a public document and disclosed to the public upon request by the
20 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to
21 approval and adoption by the Commission. If the Commission does not approve and
22 adopt this Stipulation and Final Order, then neither Dickason nor the Commission are
23 bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, and
24 understands it completely; (v) he voluntarily, without any force or duress, enters into
25 this Stipulation and Final Order and consents to issuance and entry of the Stipulated
26 Final Order below; (vi) he states that no promise or representation has been made to
27 induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an
28 attorney regarding this Stipulation and Final Order and has been fully advised with
29 regard to his rights thereto, or waives any and all rights to consult with an attorney prior
30 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated
31 Final Order below.
32 STIPULATION 0F FACTS
33 1. Daniel Barrett Dickason has been licensed by the Commission since September 12, 1981.
34 Dickason’s Substitute Teaching License, with an endorsement in Substitute Any ,
35 Specialty (PP — 12), is valid from March 18, 2013, through May 20, 2016. During all
36 relevant times, Dickason was employed by the Portland Public School District.

1 2. On May 6, 2014, Dickason was working as a substitute teacher at Lincoln High School.
2 During the course of Dickason’s duties, Dickason allowed students to actively use their
3 cell phones in class in violation of district policy and to the detriment of the class
4 assignment. Dickason allowed two students to leave campus for approximately 20
‘ 5 minutes during class time in violation of school policy and without parental or

‘ 6 administrative consent. Dickason shared overly personal information with students via
7 his Facebook profile. Dickason invited one or more students to attend his 64‘h birthday
8 party.

19 CONCLUSION 0F LAW
20 Daniel Barrett Dickason violated professional standards as described above. This
21 conduct constitutes gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-
22 020-oo4o(4)(n) as it incorporates OAR 584-020-0010(5) (Use professional judgment),
23 OAR 584-020-0025(2)(e) (Using district lawful and reasonable rules and regulations),
24 OAR 584-020-0030(2)(b) (Skill in communicating with administrators, students, stafl,
25 parents, and other patrons); and OAR 584-020-0040(4)(o) as it incorporates OAR 584-
26 020-0035(1)(c)(D) (The ethical educator, infulfilling obligations to the student, will:
27 Maintain an appropriate professional student-teacher relationship by: Honoring
28 appropriate adult boundaries with students in conduct and conversations at all times).
29 The Commission’s authority to impose discipline in this matter is based upon

2 Based on the foregoing, the Commission hereby orders as follows:
3 1. The Commission adopts and incorporates herein the above findings of fact and
4 conclusions of law, and based thereon, imposes a Public Reprimand on
5 Daniel Barrett Dickason’s Educator License. (
