6 On February 27, 2008, the Teacher Standards and Practices Commission (Commission)

7 received information that Sharon Gail Muffett (Muifett) may have provided incorrect information on her

8 December 7, 2004 application for llcensure.

9 Ms. Muffett fully cooperated with the Commission's investigation‘ After review of the matters
‘IO alleped, Ms. Muftett and the Commission agree that their respective interests, together with the public
11 interest, are best sewed by a stipulation to certain facts and a public reprimand.

12 This document sets forth the facts upon which the parties have agreed and the stipulated

13 sanction to be imposed. Ms. Mutfett stipulates that there is sufficient evidence in the Commission’s

14 files and records to support the findings of fact, conclusions of law, and order set forth below_

15 By signing below, Ms. Mufielt acknowledges, understands, stipulates, and agrees to the

16 following: (i) she has been fully advised of her rights to notice and a hearing to contest the findings of
17 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any
18 rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand ’
19 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to
20 the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon

21 and subject to approvaland adoption by the Commission. If the Commission does not approve and
22 adopt this Stipulation and Final Order, then neither Ms. Muffett nor the Commission are bound by the
23 terms herein; (iv) she has fully read this Stipulation and Final Order, and understands it completely;
24 (v) she voluntarily, without any force or duress, enters into this Stipulation and Final Order and

25 consents to issuance and entry of the Stipulated Final Order below; (vi) she states that no promises or

26 representation has been made to induce her to sign this Stipulation and Final Order; and (vii) she has

27 consulted with an attorney regarding this Stipulation and Final Order and has been fully advised with

28 regard to her rights thereto, or waives any and all rights to consult with an attorney prior to entering

1 into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This
2 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. Ms.
3 Muffett stipulates that there are sufficient facts contained in the Commissions files and records to
4 support the findings of fact and conclusions of law s'et forth below. In entering into this stipulation, Ms.
5 Muffett waives the right to a hearing to contest the findings of fact, conclusions of law and order set
6 forth below.
7 STIPULATION OF FACTS
8 I 1. The Commission has licensed Ms. Muffett since August 26, 1986. Ms. Muffett currently
9 holds a Standard Teaching License valid August 10, 2005 through December 22, 2009, with an
1O endorsement in Standard Elementary Education, authorized to teach prekindergarten through grade
1 1 eight.
12 - 2. Ms. Muffett works at the Milicoma Elementary School in the Coos Bay School District.
13 3. On September 24, 2004, Ms. Muffett was convicted 0t a misdemeanor that was later
14 reduced to a violation. This offense was unrelated to her fitness to teach.
15 4. Ms. Muffett did not report this information on her application for educational license dated
16 December 7, 2004.
17 5. Ms. Muffett has no previous disciplinary history with the Commission.

26 Sharon Gail Muffett did not report a conviction on her application for educational license. This
27 conduct constitutes Gross Neglect of Duty in violation of OAR 584-020-0040(4)(c). The Commission
28 has the authority to impose discipline in this matter under ORS 342.120 through 342.430 and OAR
29 Chapter 584.

2 The Commission adopts and incorporates herein the above finding of facts, conclusions of

3 law, and based thereon, imposes a Public Reprimand on Sharon Gail Muffett. This Order shall serve

4 as the Public Reprimand. ’
