g On or about March 8, 2012, the Teacher Standards and Practices Commission
8 (Commission) received a report from the Klamath County School District indicating that
9 Larry Morene (Morene) had violated professional standards.
1O After review of the matters alleged, Morene and the Commission agree that their
1 1 respective interests, together with the public interest, are best served by a stipulation to
12 certain facts, and the imposition of a Public Reprimand.
13 By signing below, Morene acknowledges, understands, stipulates, and agrees to
14 the following: (i) he has been fully advised of his rights t0 notice and a hearing to contest
j 15 the findings of fact, conclusions of law, and order set forth below, and fully and finally
‘ 16 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of
1 17 Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation
18 and Final Order is a public document and disclosed to the public upon request by the
19 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to
20 approval and adoption by the Commission. If the Commission does not approve and
21 adopt this Stipulation and Final Order, then neither Morene nor the Commission are
22 bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, and
23 understands it completely; (v) he voluntarily, without any force or duress, enters into
24 this Stipulation and Final Order and consents to issuance and entry of the Stipulated
25 Final Order below; (vi) he states that no promise or representation has been made to
25 induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an
27 attorney regarding this Stipulation and Final Order and has been fully advised with
28 regard to his rights thereto, or waives any and all rights to consult with an attorney prior
29 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated

31 STIPULATION OF FACTS
32 1. The Commission has licensed Larry Lehan Morene since August 1o, 1992.
33 Morene’s current Standard Teaching License with endorsements in Standard
34 Physical Education (018) and Basic Health Education (018), was issued 0n
35 January 10, 2011, and expires on January 9, 2016. During all relevant times,

1 Morene was employed by the Klamath County School District as a full time
2 teacher.
3 2. On February 25, 2012, Morene coached and chaperoned a school sponsored,
4 State Wrestling Tournament in Portland Oregon where Morene supervised
5 several student athletes. After the tournament, Morene returned to the Red Lion
6 Hotel where he and some of the students were staying in rooms paid for by school
7 funds. Dun'ng the evening of February 25, 2012, and into the early morning of
8 February 26, 2012, Morene consumed alcoholic beverages at both the restaurant
9 and bar of the hotel. Students observed Morene leaving the bar and stated during
1O interviews that they believed Morene was intoxicated. Subsequent investigation
’ 1 1 determined that during these events described above, Morene remained on duty
12 as chaperone and school representative.

2O CONCLUSION OF LAW
21 On February 25, 2012, and into the early morning of February 26, 2012, Morene,
22 while still in his capacity of chaperone and coach, became intoxicated after a school
23 sponsored event. Morene’s intoxication was observed by students. This conduct
24 constitutes gross neglect of duty in violation of ORS 342.175(1)(b); OAR 584-020-

, 25 0040(4)(n) as it incorporates OAR 584-020-0010(1) (Recognize the worth and dignity
26 of all persons and respect for each individual), OAR 584-020-0010(5) (Use professional
27 judgment), OAR 584-o2o-oo2o(2)(d) (Skill in the supervision of students), OAR 584-
28 020-oo3o(2)(b) (Skill in communicating with administrators, students, stafl, parents,
29 and other patrons); and OAR 584-020-0040(4)(g) (Appearing on duty or at any
30 district-sponsored activity while under the influence of alcohol or any controlled
31 substance).

1 The Commission’s authority to impose discipline in this matter is based upon
2 ORS 342.175.
3 ORDER
4 The Commission hereby adopts and incorporates herein the above findings of fact,
I 5 conclusions of law, and based thereon hereby imposes a public reprimand upon
l 6 Morene’s Standard Teaching License. é 2 Z fi/
