8 This matter came before the Commission on June 21, 2017, to consider Keith Wayne

9 Cantrell’s request to reinstate his Right to Apply for an educator's license that was revoked by a
1O surrender / stipulated agreement order on March 13, 2000. Keith Wayne Cantrell (Cantrell) is
11 eligible for reinstatement under the Commission's rules. Cantrell appeared before the
12 Commission unrepresented by counsel.
13 Cantrell has complied with all conditions for reinstatement required by the Commission.
14 After reviewing the evidence submitted by Cantrell along with his personal statement to the
15 Commission, the Commission grants the reinstatement of Cantrell’s right to apply for any
16 Oregon educator license he may be eligible for.

17 Now therefore, the Commission orders that Keith Wayne Cantrell’s right to apply for an
18 Oregon educator license is reinstated effective June 21, 2017.

19 Furthermore, the Commission imposes a period of one (1) year of probation upon
2O Cantrell to commence upon the issue of his Oregon educator license and subject to the

21 following terms and conditions of probation:

22 1. Cantrell shall comply with the Standards for Competent and Ethical Performance
23 of Oregon Educators under Oregon Administrative Rules Chapter 584, Division
24 020.

25 2. Cantrell will continue to regularly participate in his counseling / treatment as

26 recommended by his provider. Cantrell will provide quarterly written reports to the
27 Commission regarding his participation in treatment / counseling.

1 Violation of any term or condition of probation shall constitute an independent basis for the
2 Commission to revoke Cantrell’s educator license or otherwise impose discipline, after first
3 providing Cantrell with notice and opportunity for hearing.

6 On September 22, 1999, the Teacher Standards and Practices Commission (Commission)
7 issued a Notice of Opportunity for Hearing to Keith Cantrell in which the Commission charged
8 Mr. Cantrell with misconduct and proposed to impose discipline under ORS 342.177. Mr.
9 Cantrell filed a timely request for hearing on October 1, 1999.
10 Mr. Cantrell and the Commission have now reviewed this matter and have agreed that
11 their respective interest and the public interests would be served by entry of a stipulation to
A 12 certain facts and a voluntary surrender of Mr. Cantrell’s Oregon Teaching License. In entering
13 into this stipulation, Mr. Cantrell waives his right to a hearing and understands that the
14 Commission will accept the voluntary surrender of his license and will revoke the license.
15 Based on the foregoing, Mr. Cantrell and the Commission stipulate as follows: .
16 1. Mr. Cantrell holds a basic Oregon Teaching License which is valid until
l7 January 10, 2001i
18 2. On May 31, 1995, Mr‘ Cantrell was convicted of the crime of Resisting Arrest, a
19 misdemeanor, with reference to violating a restraining order in Linn County District Court. He
20 was placed on probation for one-year, ordered to complete an anger management program and
21 assessed fines and costs totaling $284.

.. ' 1 3. On November 12, 1998, Mr. Cantrell was convicted in Linn County Circuit Court
2 of the crime of Theft in the First Degree, a felony. He was sentenced to 18 months probation,
3 fined $2,156.50 and ordered to serve five days of community service time.
4 4. On May 21, 1999, Mr. Cantrell was convicted of the crime of Criminal Trespass
5 in the first degree, a misdemeanor, in Linn County Circuit Court. Mr. Cantrell was placed on 18-
6 months probation, was fined $60 and was ordered to serve six days of compensatory service.
7 5. On August 2, 1999, Mr. Cantrell was convicted on the crime of Forgery in the
’ 8 Second Degree, a misdemeanor, and Fraudulent Use of a Credit Card, a felony, in Linn County
9 Circuit Court. He was placed on probation for a period of 18-months, ordered to serve 20-days
10 in jail and required to pay fines and assessments in a total of $810.
11 6. On November 11, 1997, Mr. Cantrell submitted an application for a teaching
- 12 license and answered “no” to the question: “Have you ever been convicted or granted
l3 conditional discharge for any felony or misdemeanor?” His answer was false because he had
14 been convicted of a crime in 1995.
15 7. On or about January 14, 1998, Mr. Cantrell was working as a substitute teacher at
16 the Hawthorne Elementary School in the Sweet Home School District, when he used
17 unreasonable physical force by pulling a fourth grade student out of his seat by the hair.

2 The above conduct constitutes gross neglect of duty in violation of OAR 584-020-0040.
3 DISCUSSION AND ORDER
4 Mr. Cantrell’s series of criminal convictions and his inappropriate conduct in disciplining
5 a student constitutes sufiicient grounds for the Commission to accept the voluntary surrender of
6 Mr. Cantrell’s teaching license and to revoke his teaching license,
7 Under ORS 342.175(3), any person whose license has been revoked may apply to the
8 Commission for reinstatement after one-year fiom the date of revocation. If Mr. Cantrell should I
9 apply for reinstatement at some filture date, the decision would lie within the discretion of the
10 Commissioners who consider the matter at that time. Without limiting the discretion of future
ll Commissioners, it is expected that Mr. Cantrell would demonstrate, at a minimum, that he has
A l2 complied with all conditions of his criminal probations, that he has not engaged in any type of
l3 criminal misconduct, that he has taken affirmative steps through anger management classes
14 and/or counseling to ensure that he will not again engage in inappropriate disciplinary methods
15 when dealing with students, and that he has committed no acts which would constitute a
16 violation of professional standards under OAR 584 Division 20.
17 Based on the foregoing, the Commission accepts the voluntary surrender of
18 Mr. Cantrell’s Oregon teaching license and revokes the license.
