g On May 5, 2009, Curtiss Shelley was referred for an investigation regarding possible
8 misconduct.
9 After review of the matters alleged, Mr. Shelley and the Commission agree that their
10 respective interests, together with the public interest, are best served by a stipulation to oertain facts
11 and a public reprimand.
12 This document sets forth the facts upon which the parties have agreed and the stipulated
‘ 13 sanction to be imposed. Mr. Shelley stipulates that there is sufficient evidence in the Commission's
i 14 files and records to support the findings of fact, conclusions of law, and order set forth below.
‘ 15 By signing below, Mr. Shelley acknowledges, understands, stipulates, and agrees to the
16 following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings of
17 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any
18 rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand
19 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to
20 the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon
21 and subject to approval and adoption by the Commission. If the Commission does not approve and
22 adopt this Stipulation and Final Order, then neither Mr. Shelley nor the Commission are bound by the
23 terms herein; (iv) he has fully read this Stipulation and Final Order, and understands it completely; (v)
24 he voluntarily, without any force or duress, enters into this Stipulation and Final Order and consents to
25 issuance and entry of the Stipulated Final Order below; (vi) he states that no promises or
26 representation has been made to induce him to sign this Stipulation and Final Order; and (vii) he has
27 consulted with an attorney regarding this Stipulation and Final Order and has been fully advised with
28 regard to his rights thereto, or waives any and all n'ghts to consult with an attorney priorto entering ‘
29 into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This

1 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. Mr.
2 Shelley stipulates that there are sufficient facts contained in the Commission's files and records to
3 support the findings of fact and conclusions of law set forth below. In entering into this stipulation, Mr.
4 Shelley waives the right to a hearing to contest the findings of fact, conclusions of law and order set
5 forth below.
6 STIPULATION OF FACTS
7 1. Mr. Shelley was first licensed as a teacher on June 22, 1992. Mr. Shelley currently holds
8 an Initial Administrator license that was issued on August 26, 2009 and expires June 27,
9 2013. He also holds a Standard Teaching License, with endorsements in Basic Math and
10 Physical Education, issued June 28, 2009 that expires June 27, 2014.
1 1 2. Between July 1, 2007 and June 27, 2009, Mr. Shelley was employed by the Grant School
12 District. He did not have an administrator license during this time period, but was identified
13 as Vice Principal on official school district communications.

24 CONCLUSIONS OF LAW
25 1. By engaging in the conduct in paragraph 2 above, Mr. Shelley violated ORS 342.175(1)(b);
26 OAR 584-020‘0040(4)(n) as it incorporates OAR 584-020-0010(5) (Use of professional
27 judgment).

2 The Commission adopts and incorporates herein the above finding of facts, conclusions of
3 law, and based thereon, imposes a Public Reprimand on Curtiss Dean Shelley. This Order shall
4 serve as the Public Reprimand.
