O .1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the I Teaching License of STIPULATION, PUBLIC REPRJMAND 4 AND ORDER OF PROBATION GAIL ANN HULT 5 6 The Teacher Standards and Practices (Commission) issued a Notice of Opportunity for 7 Hearing on March 11, 2004, to Gail Ann Hult. Ms. Hult requested a hearing on March 15, 2004, 8 and the case was assigned t0 Office of Administrative Hearings for purposes of assignment to an 9 Administrative Law Judge and scheduling a hearing. 10 After a review of the matters alleged, the Commission and Ms. Hult have agreed that 1 1 their respective interests, together with the public interest, are best served by a stipulation to ’ 2 certain facts, the issuance of a public reprimand and placement of Ms. Hult on probation for a ‘3 period of two years. 14 In entering into this stipulation, Ms. Hult waives her right to a hearing and understands 15 that the Commission will impose the discipline set forth in this order. This stipulation and 16 proposed order are contingent on approval by the full Commission. If the Commission does not 17 approve this stipulation and order, it is understood that any waiver of rights by Ms. Hult is 18 therefore revoked. It is further understood that the statements contained in this stipulation may 19 not be used by either the Commission or Ms. Hult for any reason if the Commission fails to 20 approve the stipulation and proposed order. 21 STIPULATION OF FACTS 22 Ms. Hult and the Commission stipulate as follows: ‘3 Page l - STIPULATION AND ORDER — GAIL ANN HULT i GENK5042..doc O O .1 1. Ms. Hult holds an Oregon Standard Teaching License with a Standard 2 Handicapped Learner 1, Basic Elementary and Basic Biology endorsements. She has been 3 licensed in Oregon since September 1977. 4 2. Ms. Hult has served as a special education teacher for the Perrydale School 5 District since August 1986. During the 2002-3 school year, Ms. Hult was employed as a special 6 education teacher at the Perrydale High School. 7 3. In October 1, 2002, Ms. Hult participated in a meeting to develop an 8 Individualized Education Program (IEP) for a student with disabilities who was a resident of the 9 Dallas School District and who had been placed for his educational program at the Perrydale 10 High School. Federal and State laws require certain individuals to attend IEP meetings, 11 including the child’s student’s parent(s) and a representative of the student’s resident school ‘ 7. district. ‘3 4. During or following the October 1 meeting, Ms. Hult prepared various documents 14 related to the student’s educational program and placement. Among these documents were a 15 Statement of Eligibility Coversheet to establish the student’s continuing eligibility for special 16 education services and a Documentation of Placement Decision form for the student to be placed 17 in a regular classroom with supplemental special educations services. Both of the documents 18 purported to contain the signatures of the student’s mother and a named representative from the l9 Dallas School District. However, neither of these persons reviewed or signed the documents. 20 5. This conduct constituted gross 4 neglect of duty in violation of OAR 584-020-0040(4)(c). 5 ORDER i 6 The Commission issues a public reprimand to Gail Ann Hult and this order shall serve as 7 the public reprimand.
