BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION / OF THE STATE OF OREGON In the Matter of the ) Teaching License of ) DEFAULT ORDER WENDELL OLIVER ELISEUSON ) REVOKING TEACHING LICENSE ) On 0r about October 14, 1996 the Teacher Standards and Practices Commission received information from the Jackson County District Attorney‘s office, indicating that Wendell Oliver Eliseuson had entered a plea of "no contest" to two counts of Harassment. A condition of the plea was surrender of his Oregon Teaching License. The Executive Secretary took action to notify Mr. Eliseuson of intent to accept the surrender and revoke his Oregon Teaching license, and to inform him of his opportunity for hearing. The notice, dated November 12, 1996, and signed by David V. Myton, Executive Secretary, stated: "You. are entitled to a contested case hearing on the proposed action. The purpose of the hearing would be to establish that a conviction has been entered in Jackson County for Harassment. You have 10 days ‘ from the date of this letter to request a hearing. "" The notice of opportunity for hearing was sent by U.S. Certified Mail, Return Receipt Requested. Mr. Eliseuson did not request a hearing. I‘ FINDINGS OF FACT 1. On October 9, 1996, Wendell Oliver Eliseuson entered a plea of "no contest" to two counts of Harassment in Jackson County District Court. This Harassment consist of Eliseuson subjecting female students at Ashland High School to offensive physical contact, by touching their buttocks. 2. A condition of the plea was that Eliseuson surrender his Oregon Teaching License. ULTIMATE FINDINGS OF FACT Wendell Oliver Eliseuson entered a plea of "no contest" and was convicted of two counts of Harassment on October 9, 1996, in Jackson County District Court. CONCLUSIONS OF LAW Wendell Oliver Eliseuson violated the Standards for Competent and Ethical Performance of Oregon Educators. OAR 584-20-040 by subjecting female students to offensive physical contact.
