1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 STATE OF OREGON 3 4 In the Matter of the Teaching License of: ) DEFAULT ORDER OF LICENSE 5 WALTER ROLLA WEBER ) REVOCATION AND REVOCATION 6 ) OF RIGHT TO APPLY FOR LICENSE 7 8 On January 11, 2010, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Waiter Rolla Weber (Weber) in which the Commission 10 charged him with Gross Neglect of Duty pursuant to ORS 342143(3). The Notice was sent via U.S. 11 First Class Mail and U.S. Certified Mail Receipt 7009 1410 0002 1925 4492 to the address on file 12 with the Commission. Mr. Weber signed for the certified mail on January 12, 2010. The Notice of 13 Opportunity of Hearing, dated January 11, 2010, and signed by Victoria Chamberlain, Executive 14 Director, stated: 15 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD, l6 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR 17 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. 18 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A HEARING, 19 THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY INCLUDE THE 20 REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER DISCIPLINE.” 21 s 22 On January 25, 2010, Mr. Weber requested a hearing. On April 30, 2010, Mr. Weber, 23 through his attorney, withdrew his request for a hearing. The Commission, therefore, finds Mr. 24 Weber to be in default and enters the following findings of fact, conclusions of law and order, based 25 on the files and records of the Commission concerning this matter. 26 FINDINGS 0F FACT 27 1. On July 10, 2009, Mr. Weber was arrested for soliciting a prostitute. On August 5, 2009, he pled 28 guilty to Prostitution, ORS 167.007(1)(b) and entered into a diversion agreement (whereby, subject 29 to his completion of certain conditions, his conviction would be dismissed after a period 0f one 30 year). 31 2. On July 10, 2009, in Springfield, Oregon, Mr. Weber contacted an undercover police officer who 32 was posing as a prostitute and offered and agreed to pay her money in exchange for sexual 33 contact. PAGE IADEFAULT ORDER OF LICENSE REVOCATION AND REVOCATION OF RIGHT TO APPLY FOR LICENSE — WEBER, WALTER 1 CONCLUSIONS OF LAW 2 Walter Rolla Weber's solicitation of prostitution constitutes gross neglect of duty in violation 3 of ORS 342.175(1)(b); OAR 584-020-0040(1)(kk) (Prostitution); and gross unfitness in violation of 4 ORS 342.175(1)(c); OAR 584-020-0040t5)(c) (Conviction of violating any federal, state, or local 5 law. A conviction includes any final judgment of conviction by a court whether as the result of guilty 6 plea, no contest plea or any other means) and OAR 584-020-0040(5)(e) (Admission of or engaging 7 in acts constituting criminal conduct, even in the absence of a conviction).
