l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 JOHN D. PARKS ) FINAL ORDER OF REPRlMAND , 6 On October 11, 2006, the Teacher Standards and Practices Commission (Commission) 7 received a report from Sandra Husk, Superintendent, Salem-Keizer School District, that John D. 8 Parks (Parks) may have violated standards by submitting false marks for members of his track team 9 and encouraged two students to provide false information if asked about the inflated marks. 10 Mr. Parks fully cooperated with the Commission's investigation. After review of the mattels 11 alleged, Mr. Parks and the Commission agree that their respective interests, together with the public 12 interest, are best served by a stipulation to certain facts and a public reprimand. 13 This document sets forth the facts upon which the parties have agreed and the stipulated 14 sanction to be imposed. Mr. Parks stipulates that there is sufficient evidence in the Commission’s 15 files and records to support the findings of fact, conclusions of law, and order set forth below. 16 By signing below, Mr. Parks acknowledges, understands, stipulates, and agrees to the 17 following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings of 18 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any 19 rights to appeal or othenlvise challenge this Stipulation of Facts and Final Order of Reprimand 20 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed 21 to the public upon request by the Commission; Gii) this Stipulation and Final Order is contingent upon 22 and subject to approval and adoption by the Commission. lfthe Commission does not approve and 23 adopt this Stipulation and Final Order, then neither Mr. Parks northe Commission are bound by the 24 terms herein; (iv) he has fully read this Stipulation and Final Order, and understands it completely; (v) 25 he voluntarily, without any force or duress, enters into this Stipulation and Final Order and consents to 26 issuance and entry of the Stipulated Final Order below; (vi) he states that no promises or 27 representation has been made to induce him to sign this Stipulation and Final Oder; and (vii) he has 28 consulted with an attomey regarding this Stipulation and Final Order and has been fully advised with 1 regard to his rights thereto, or waives any and all rights to consult with an attorney prior to entering 2 into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This 3 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. M. 4 Parks stipulates that there are sufficient facts contained in the Commission’s files and records to 5 support the findings of fact and conclusions of law set forth below. In entering into this stipulation, Nlr. 6 Parks waives the right to a hearing to contest the findings of fact, conclusions of law and order set 7 forth below. 8 STIPULATION OF FACTS 9 1. The Commission has licensed Mr. Parks since September 3, 1999. Mr. Parks currently holds 10 an Initial I Teaching License valid January 20, 2006 through January 19, 2010, with an 11 endorsement in Social Studies at the high school level. Mr. Parks also holds a Conditional 12 Assignment Permit for the Salem-Keizer School District, valid December 18, 2007 through 13 December 17, 2010 with an endorsement in English for Speakers of Other Languages at the 14 middle and high school levels. 15 2. Mr. Parks submitted false marks (reflecting estimated/practice results rather than official meet 16 results) for entry of at least two student athletes on the McKay High School track team in the 17 XO invitational meet in Eugene in April, 2006. 18 . 3. Mr. Parks encouraged two students to provide false information if asked about their track 19 performance and marks. 20 4. Parks provided false information about student athletic performance and encouraged . 3 students to provide false information if asked about the practice. This conduct constitutes Gross 4 Neglect of Duty in violation of OAR 584-020-0040(4)(c) (Knowing falsification of any document or 5 knowing misrepresentation directly related to Iicensure, employment, or professional duties). The 6 Commission has the authority to impose discipline in this matterunder ORS 342.120 through 342.430 7 and OAR Chapter 584. 8 FINAL ORDER 9 The Commission adopts and incorporates herein the above finding of facts, conclusions of 10 law, and based thereon, imposes a Public Reprimand on John Parks.
