1 BEFORE THE TEACHER STANDARDS AND PRACTtCES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 SHERYL BUCK-WILLIAMS ) FINAL ORDER OF REPRIMAND 6 0n September 11, 2007, the Teacher Standards and Practices Commission (Commission) 7 received information that Sheryl Buck-Williams may have engaged in gross neglect of duty or gross 8 unfitness. 9 Ms. Buck-Williams fully cooperated with the Commission's investigation. After review of the 10 matters alleged, Ms. Buck-Witliams and the Commission agree that their respective interests, together 11 with the public interest, are best served by a stipulation to certain facts and a public reprimand. 12 This document sets forth the facts upon which the parties have agreed and the stipulated 13 sanction to be imposed. Ms. Buck-Williams stipulates that there is sufficient evidence in the 14 Commission's files and records to support the findings of fact, conclusions of law, and order set forth 1 5 beiow. 16 By signing below, Ms. Buck-Williams acknowledges, understands, stipulates, and agrees to 17 the following: (i) she has been fully advised of her rights to notice and a hearing to contest the 18 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all such 19 rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of 20 Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and 21 disclosed to the public upon request by the Commission; (iii) this Stipulation and Finai Order is 22 contingent upon and subject to approval and adoption by the Commission. lf the Commission does 23 not approve and adopt this Stipulation and Final Order, then neither Ms. Buck-Williams nor the 24 Commission are bound by the terms herein; (iv) she has fully read this Stipulation and Final Order, 25 and understands it completely; (v) she voluntarily, without any force or duress, enters into this 26 Stipulation and Final Order and consents to issuance and entry of the Stipulated Final Order below; 27 (vi) she states that no promises or representation has been made to induce her to sign this Stipulation 28 and Final Order; and (vii) she has consulted with an attorney regarding this Stipulation and Final Page 1 - STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - BUCK-WILLIAMS 1 Order and has been fully advised with regard to her rights thereto, or waives any and all rights to 2 consult with an attorney prior to entering into this Stipulation and Final Order and issuance and entry 3 of the Stipulated. Final Order below. This Order sets forth the facts upon which the parties have 4 agreed and the sanction to be imposed. Ms. Buck-Williams stipulates that there are sufficient facts 5 contained in the Commission's files and records to support the findings of fact and conclusions of law 6 set forth below. ln entering into this stipulation, Ms. Buck-Williams waives the right to a hearing to 7 contest the findings of fact, conclusions of law and order set forth below. 8 STIPULATION OF FACTS 9 1. The Commission has licensed Ms. Buck-Wiliiams since November 15, 1999. Ms. Buck- 10 Williams currently holds a Standard Personnel Service License with a Standard Counselor 11 endorsement valid until October 27, 2011. 12 2. On June 15,2007, Ms. Buck-Williams signed a Child Attending School Confirmation form 13 for a student attending South Salem High School. The form is used by the Division of Child Support ' ' 1'4 to determine child support obligations for chiidren over 18 years of age. Ms. Buck-Wiiliams marked -1 =1 ~15 between “yes” and “no” on a question asking “is the student named above maintaining satisfactory . ~ . -16 academic progress as defined by the school?" and also stated that the student “performed at his usual 17 level of passing 6 out of 8 classes." The student was actually failing a majority of his classes at the 18 time. 19 3. On August 30, 2007 Ms. Buck-Williams told school administrators that she completed 20 the form indicating the student was passing his ciasses . On January B, 2008, during an investigative 21 meeting with a Commission investigator, Buck-Williams explained that she meant to indicate on the 22 form that the student was failing, and that she made a clerical error. 23 IT IS SO S ULATED AND AGREED TO: 24 W QQJJW Z 4M. 25 Sheryl B - illiams Da e g; w g MM //‘ 545 28 Victoria Ch ' , Executive Director Date 29 Teacher Standards and Practices Commission Page 2 - STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - BUCK-WILLIAMS 1 CONCLUSIONS OF LAW 2 Ms. Buck-Williams conduct as stated in paragraphs 2 and 3 above constitutes Gross Neglect 3 of Duty in violation of OAR 584-020-0040(4)(c) and OAR 584-020-0040(4)(n) as it incorporates OAR 4 584-020-0010(5). The Commission has the authority to impose discipline in this matter under ORS 5 342.120 through 342.430 and OAR Chapter 584. 6 FINAL ORDER 7 The Commission adopts and incorporates herein the above finding of facts, conclusions of 8 law, and based thereon, imposes a Public Reprimand on Sheryl Buck-Williams.
