a v . ~ HECEIV ED 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMIS ION JUL Z 7 2°11 2 OF THE STATE OF OREGON ~ T 9W SM a‘ 3 In the Matter of the ) STIPULATION OF FA . -'. ‘3: comm 4 Administrative License of ) FINAL ORDER OF SUSPENSION (55 ANTHONY PATRICK LANNI ) 7 During the course of another investigation the Teacher Standards and Practices 8 Commission (Commission), discovered information that Anthony Patrick Lanni (Lanni), 9 failed to report the misconduct of a teacher in the district where he was Superintendent. 10 After review of the matters alleged, Lanni and the Commission agree that their 1 1 respective interests, together with the public interest, are best served by a stipulation to 12 certain facts and the imposition of a 60 day Suspension of his right to apply. 13 By signing below, Lanni acknowledges, understands, stipulates, and agrees t0 the 14 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 15 findings of fact, conclusions of law, and order set forth below, and fully and finally 16 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of 17 Facts and Final Order of Suspension (Stipulation and Final Order); (ii) this Stipulation 18 and Final Order is a public document and disclosed to the public upon request by the 19 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to 20 approval and adoption by the Commission. The Commission has licensed Lanni since May 16, 1995. Lanni’s current 3 Standard Administrative License, with a Standard Superintendent endorsement, 4 issued on April 1, 2003, expired on May 12, 2008. Lanni has not applied for 5 renewal of his Standard Administrative License. During all relevant times, Lanni 6 was employed as Superintendent of the North Central Education Service District 7 (ESD). 8 2. Tim Haney was employed by the North Central ESD beginning August 26, 2006. On 9 October 2, 2006, the Commission received Mr. Haney’s application for an Oregon 10 teaching license. On October 5, 2006, the Commission, at the request of the North 1 1 Central ESD, issued an Emergency Administrator License and an Emergency Teaching 12 license for Mr. Haney through an expedited service offered by the Commission. Mr. 13 Haney entered into an employment contract with the district on October 1, 2006. The 14 Commission issued Mr. Haney a Transitional Administrator License and a Transitional 15 Teaching License on December 7, 2006. Mr. Haney substitute taught for a total of 20 16 days in the special education program before receiving his Oregon license. 17 3. Lanni allowed Mr. Haney to teach in the North Central ESD without an Oregon teaching 1 8 license. 19 4. On August 4, 2006, the Commission adopted a Stipulated Agreement, imposing a Public 20 Reprimand upon Lanni’s license for assigning another educator in violation of licensure 21 requirements. 22 5. On February 28, 2006, the Grant ESD terminated the employment of James Bowler after 23 Lanni placed him on administrative leave on February 10, 2006, for a variety of issues 24 including: sexual harassment allegations against Bowler by female subordinates and 25 incompetence related to proper IEP maintenance. None of these issues were reported to 26 the Commission. 27 6. On November 5, 2010, the Commission revoked the right of James A. This conduct constitutes gross neglect of duty in violation of ORS 4 342.175(1)(b); OAR 584-020-oo4o(4)(i) (Deliberately assigning an educator in 5 violation of licensure requirements) and OAR 584-020-004o(4)(n) as it incorporates 6 OAR 584-020-0010(5) (Use professional judgment). 7 Lanni’s failure to report the conduct of James Bowler constitutes gross neglect of 8 duty in violation of ORS 342.175(1)(b); OAR 584-020-004o(4)(n) as it incorporates OAR 9 584-020-001o(5) (Use professional judgment) and OAR 584-020-0041(3) (A chief 1O administrator will report to the Executive Director within thirty (30) days the name of 1 1 any person described in subsection (2) above, when the chief administrator reasonably 12 believes the person may have committed any act which may constitute any of the 13 designated acts of gross neglect of duty under OAR 584-o2o-oo4o(4), subsections (a) 14 to (i), (k) to (o) or (q) or any 0f the designated acts of gross unfitness listed under OAR 1 5 584-020-0040(5), subsections (a) to (e). 16 The Commission’s authority to impose discipline in this matter is based upon 1 7 ORS 342.175. 1 8 ORDER 19 Based on the foregoing, the Commission hereby orders that Anthony Patrick Lanni’s 20 right to apply for a license is hereby suspended for a period of 60 days. 21 Issued and dated this May of July, 2011. 22 TEACHER STANDARDS AND PRACTICES COMMISSION 23 STATE OF E REGON 22 By i ,1/54”!
