Novotney, Superintendent of Dallas I 12 School District, indicating that Hardie Scott Rollins may have violated Commission rules 13 of professional conduct. 14 Mr. Rollins fully cooperated with the Commission’s investigation. After review of 15 the matters alleged, Mr. Rollins and the Commission agree that their respective ‘S interests, together with the public interest, are best served by a stipulation to certain 17 facts and the imposition of a two year period of probation. Mr. Rollins understands that 18 the probation wilI be subject to specific conditions‘ This Order sets forth the facts upon 19 which the parties have agreed and the sanction to be imposed. In entering into this 20 stipulation, Mr. Rollins waives the right to a hearing to contest the findings of fact, 21 conclusion of law and order set forth below. 22 This stipulation is contingent upon approval and adoption of the Order by the 23 Commission. If the Commission does not adopt this Order, neither Mr. Rollins nor the 24 Commission are bound by the contents of the stipulation, and Mr. Rollins retains all 25 rights to a hearing on the allegations. 26 /// I Page 1 STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION ~ ROLLINS GENG4984 1 STIPULATION OF FACTS AND ORDER 0F PROBATION . 1. Mr. Rollins holds a Transitional Teaching License with Basic Mathematics, 3 Basic Physical Education and Basic Health Education Endorsements effective July 17, 4 2000, valid until July 17, 2003. 5 2. Mr. Rollins was employed by Molalla River School District as a Math Teacher 6 at Molalla High School from August 2000 until June of 2001. 7 3. Mr. Rollins was employed by Dallas School District as a High School Teacher 8 from August 28, 2001 until dismissal effective November 30, 2001. 9 4. Scott McLeod was Mr. Rollins’ supervisor at Dallas High School. In the fall of 10 2001, Mr. McLeod received information that caused him to be concerned about Mr. 11 Rollins’ communication with a student at Molalla High School. 12 5. When questioned by Mr. McLeod, Mr. Rollins stated that he had had very little ' contact with the student and had not spoken to the student about any of the student's 14 personal issues. Hardie Scott Rollins failed to acknowledge to his supervisor the extent of his 3 contacts with a high school student and the nature of his discussions with the student. 4 This misconduct constitutes gross neglect of duty in violation of OAR 584-020- 5 0040(4)(c). 6 ORDER 7 Based upon the foregoing, the Commission places Mr. Rollins on probation for a 8 period of two years, subject to the following conditions: 9 1. Mr. Rollins shall, at his own expense, engage in training concerning 10 appropriate professional boundaries though a qualified trainer, approved in advance by 11 the Commission. Such counseling shall include at least eight (8) one-hour sessions. 12 Mr. Rollins will provide the trainer with a copy of this Order and the District's report to . the Commission. The trainer will provide the Commission with a report of successful 14 program completion. 15 2. Mr. Rollins shall comply with all Standards for Competent and Ethical 16 Performance under Chapter OAR 584, Division 020. 17 Violation of the terms of this probation may constitute an independent basis for 18 the Commission to impose discipline, up to and including revocation of Mr. Rollins’ 19 teaching license, subject to Mr. Rollins’ right to a hearing on the issue of whether he . 20 violated probation.
