WEAVER ) (75 8 This matter came before the Commission on January 30, 2015, to consider Jonah 9 Weaver's request to reinstate his Right to Apply for an Oregon educator's license that was 10 revoked on October 24, 2008. Mr. Weaver is eligible for reinstatement under the Commission's 11 rules. Mr. Weaver appeared before the Commission represented by Liz Joffe. 12 Jonah Weaver has complied with all conditions for reinstatement required by the ‘ 13 Commission. After reviewing the evidence submitted by Mr. Weaver along with his personal 14 statement to the Commission, the Commission grants the reinstatement of Jonah Weaver's 15 Oregon educator license and the reinstatement of Mr. Weaver's right to apply for any Oregon '16 educator license he may be eligible for. The Commission commends Mr. Weaver for the 17 commitment he has made toward his sobriety over the past several years The Commission has 18 an expectation that Mr. Weaver will continue in the treatment of his chemical dependencies with 19 the same commitment he has made in the past and represented to the Commission on January 20 30, 2015. 21 Now therefore, the Commission orders that Jonah M. After review of the 10 matters alleged, Mr. Weaver and the Commission agree that their respective interests, together 11 with the public interest, are best served by a stipulation to certain facts and revocation of Mr. 12 Weaver's right to apply for an Oregon teaching license. 13 Mr. Weaver agrees that the Commission has the authority to investigate the allegations 14 against him, make findings of fact and conclusions of law. Mr. Weaver understands that the . Commission will rely upon these findings to revoke his right to apply for a license and waives his 16 right to appeal the revocation of his right to apply for a license. 17 This document sets forth the facts upon which the parties have agreed and the 18 stipulated sanction to be imposed. Mr. Weaver stipulates that the TSPC has the statutory 19 authority to rely upon these facts to support this order and he will not contest this order. 20 By signing below, Mr. Weaver acknowledges, understands, stipulates, and agrees to the 21 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 22 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 23 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts, and Final 24 Order of Revocation of Right to Apply (Stipulation and Final Order); (ii) this Stipulation and Final 25 Order is a public document and disclosed to the public upon request by the Commission; 26 (iii) this Stipulation and Final Order is contingent upon and subject to approval and adoption by ' the Commission. The Commission has licensed Mr. Weaver since August 7, 2003. Mr. Weaver held a 1O Initial l Teaching License with a Language Arts Endorsement, issued June 15, 2004 that expired 11 April 8, 2008. Mr. Weaver did not apply to have his license renewed. 12 2. Mr. Weaver began employment with Portland Public School on September 5, 2003 13 serving as an English, Social Studies (Alternative Education) and Business Education teacher. . Mr. Weaver resigned at the end of the 2006 school year. 15 3. On May 25, 2006, one 17 year-old student and one 18 year-old former student 16 reported to school officials that on certain occasions they consumed alcohol and smoked 17 marijuana with Mr. Weaver at his home. 18 4. The above described conduct further constitutes 5 gross neglect of duty under ORS 342.175(1)(b), in violation of OAR 584-020-0040(4)(n) as it 6 incorporates OAR 584-020-0010(5) and gross unfitness under ORS 342.175(1)(c) in violation of 7 OAR 584-020-0040(5)(e), specifically ORS 471.410.
