7 On or about April 13, 2009, the Teacher Standards and Practices Commission
8 (Commission) received a report indicating that Mr. Prince may have engaged in conduct
9 constituting gross neglect of duty.
10 The Commission charged Mr. Prince with gross neglect of duty and issued a Notice of
11 Opportunity for Hearing on December 18, 2009. After review of the matters alleged, Mr. Prince
12 and the Commission agree that their respective interests, together with the public interest, are
13 best served by a stipulation to certain facts and the suspension of his right to apply for a license.
14 By signing below, Mr. Prince acknowledges, understands, stipulates, and agrees to the
15 following: (i) he has been fully advised of his rights to notice and a hearing to contest the
16 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all
17 such rights and any rights to appeal or othewvise challenge this Stipulation of Facts and Final
18 Order of Suspension of Right to Apply (Stipulation and Final Order); (ii) this Stipulation and Final
19 Order is a public document and disclosed to the public upon request by the Commission;
20 (iii) this Stipulation and Final Order is contingent upon and subject to approval and adoption by
21 the Commission. If the Commission does not approve and adopt this Stipulation and Final
22 Order, then neither Mr. Prince nor the Commission are bound by the terms herein; (iv) he has
23 fully read this Stipulation and Final Order, and understands it completely; (v) he voluntarily,
24 without any force or duress, enters into this Stipulation and Final Order and consents to
25 issuance and entry of the Stipulated Final Order below; (vi) he states that no promises or
26 representation have been made to induce him to sign this Stipulation and Final Order; and (vii)
27 he has consulted with an attorney regarding this Stipulation and Final Order and has been fully

1 advised with regard to his rights thereto, or waives any and all rights to consult with an attorney
2 prior to entering into this Stipulation and Final Order and issuance and entry of the Stipulated
3 Final Order below.
4 STIPULATION OF FACTS
5 1. The Commission first licensed Mr. Prince on April 14, 2003. Mr. Prince most recently
6 held an Initial l Teaching License with an endorsement in Multiple Subjects MIDLVL and Social
7 Studies HS, ML that was valid from February 26, 2007 through February 5, 2010. Mr. Prince
8 applied for renewal of his Initial I License on February %, 2010..
9 2. During all relevant times, Mr. Prince was employed by the Springfield School District
1O as a substitute teacher
11 3. On or about March 19, 2009, Mr. Prince, while substituting at Gateways
12 Alternative School, suggested that student MC, a middle school female, view a music video on
13 YouTube by the artist Bjork called Army of Me. That video would not play correctly so Mr.
14 Prince suggested MC try a related Bjork video called All Is Full of Love, which contains sexually
15 suggestive content not appropriate for the student and viewing it made her uncomfortable. Mr.
16 Prince admitted to suggesting the video to MC and that doing so was not a good decision.

25 Mr. Prince's conduct described in paragraph 3 above is a violation of ORS
26 342.175(1)(b), OAR 584-020-0040(4)(n) as it incorporates 584-020-0035(1)(c)(D) and OAR
27 584~O20-0040(4)(n) as it incorporates OAR 584-020—0010(5).

1 The Commission has the authority to impose discipline in this matter under ORS
2 342.120 through 342.430 and OAR Chapter 584. .
3 FINAL ORDER
4 The Commission adopts and incorporates herein the above findings of facts and
5 conclusions of law and hereby suspends Mr. Prince's right to apply for reinstatement of his
6 Initial l Teaching License for six (6) months from the date oi this order.
7 Furthermore, the Commission imposes a one (1) year probation upon Mr. Prince to
8 commence after reinstatement of his linoense and subject to the following terms and conditions
9 of probation:
10 1. Mr. Prince shall report in writing within ten days to the Executive Director of the
11 Commission any arrest or citation for any felony, misdemeanor, major traffic violation or criminal
12 probation; and
13 2. Mr. Prince shall comply with the Standards for Competent and Ethical Performance of
14 Oregon Educators under Oregon wmes Chapter 584, Division 020.
