, 1 e t t 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 CARL FREDERICK SANDER ) g On or about May 11, 2009, the Teacher Standards and Practices Commission 8 (Commission) received a report from the North Clackamas School District, indicating 9 Carl Frederick Sander (Sander), consumed alcohol during a school sponsored trip and 1O while responsible for student supervision. 1 1 After review of the matters alleged, Sander and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to 13 certain facts and the imposition of a Public Reprimand on Sander’s Initial I Teaching 1 4 License. 1 5 By signing below, Sander acknowledges, understands, stipulates, and agrees t0 16 the following: (i) he has been fully advised of his rights to notice and a hearing to contest 17 the findings of fact, conclusions of law, and order set forth below, and fully and finally 18 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of 19 Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation 20 and Final Order is a public document and disclosed to the public upon request to the 21 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to 22 approval and adoption by the Commission. The Commission has licensed Carl Frederick Sander as a teacher in Oregon since 8 January 10, 2003. Sander’s current Initial I Teaching License, with endorsements in 9 Basic Mathematics (HS, ML) and Multiple Subjects (MIDLVL), issued 0n May 29, 1 O 2010, is valid until April 2, 2013. Sander also held a Conditional Assignment Permit, 1 1 (CAP) with an endorsement in Advanced Mathematics, issued October 30, 2008, and 12 expired January 22, 2012, for service in the North Clackamas School District. During 13 all relevant times, Sander was employed by the North Clackamas School District. 14 2. In the spring of the 2008-2009 school year, Sander acted as a coach/chaperone on a 15 school trip out of state. During the trip Sander consumed one 20 ounce beer while 16 outside of the presence of students. Students report that some of the coaches were 17 visibly intoxicated at some point during the trip. Sander denies having been 1 8 intoxicated. 1 9 3. During the same trip, while driving students in a van, Sander briefly, (one block) 20 drove the van off the main road and onto a raised, paved path (golf cart pathway) 21 alongside the main road as a joke. Sander had not been drinking. 22 4. I 1 CONCLUSION OF LAW 2 Carl Frederick Sander consumed alcohol on a school sponsored trip where he acted as a 3 chaperone/ coach. This conduct constitutes gross neglect of duty in violation of ORS 4 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-020-0010(5) (Use 5 professional judgment),and OAR 584-020-0020(2)(d) (Skill in the supervision 0f students). 6 Sander transported students in an unsafe manner.
