8 On September 22, 2010, the Teacher Standards and Practices Commission

9 (Commission) issued a Notice of Opportunity for Hearing to Wend Kay Cannin (Cannin)
10 in which the Commission charged her with conviction of crimes listed in ORS
11 342.143(3). The Notice was sent via U.S. First Class Mail and U.S. Certified Mail
12 Receipt 7010 0290 0001 6831 4428 to the address on file with the Commission. The
13 Certified mail receipt was returned and signed for by Coffee Creek Corrections. The
I4 Notice of Opportunity of Hearing, dated September 22, 2010, and signed by Victoria

_ 15 Chamberlain, Executive Director, stated:
16 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY
17 PERIOD, YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED
18 UNLESS YOUR FAILURE TO REQUEST A HEARING WAS BEYOND YOUR
19 REASONABLE CONTROL. IF YOU DO NOT REQUEST A HEARING OR IF
20 YOU FAIL TO APPEAR AT A HEARING, THE COMMISSION WILL ADOPT AN
21 ORDER OF DEFAULT WHICH MAY INCLUDE THE REVOCATION OR ' ~ >-
22 SUSPENSION OF YOUR LICENSE OR OTHER DISCIPLINE."

24 Cannin did not request a hearing. The Commission, therefore, finds Cannin to be in
25 default and enters the following findings of fact, conclusions of law and order, based on
26 the files and records of the Commission concerning this matter.
27 FINDINGS OF FACT
28 1. Cannin has been licensed by the Commission since April 28, 2006. Cannin’s
29 Initial l Teaching license issued on April 28, 2006, expired on July 22, 2009, with
30 an endorsement in Multiple Subjects Self-Contained.
31 2. On July 29, 2010, in the Circuit Court of the State of Oregon for Morrow County,
32 Cannin pled guilty, and was convicted of Sexual Abuse 3. _
33 3. On July 29, 2010, in the Circuit Court of the State of Oregon for Morrow County,

1 Cannin pled guilty, and was convicted of Rape 3. _
2 4. On July 29, 2010, in the Circuit Court of the State of Oregon for Morrow County,
3 Cannin pled guilty, and was convicted of Sodomy 3. _
4 ' CONCLUSIONS OF LAW
5 Wendy Kay Cannin's conduct as described in paragraph 1 above, constitutes
6 gross neglect of duty in violation of OAR 58+020-0040(1)(0) and ORS 163.415, Sexual
7 Abuse in the Third Degree.
8 Cannin's conduct as described in paragraph 2 above, constitutes gross neglect
9 of duty in violation of OAR 584-020-0040(1)(e) and ORS 163.355, Rape in the Third
10 Degree.
11 Cannin’s conduct as described in paragraph 3 above constitutes gross neglect of
12 duty in violation of OAR 584-020-0040(1)(h) and ORS 163.385, Sodomy in the Third
13 Degree.
14 The Commission is required to revoke Cannin's right to apply for a license
15 pursuant to ORS 342.175(2). The Commission's authority to impose discipline in this
16 matter is based upon ORS 342.175.
17 FINAL ORDER
18 The Commission hereby revokes Wendy Kay Cannin's right to apply for an
19 educator license.
