7 On or about May 1, 2009 the Teacher Standards and Practices Commission

8 (Commission) discovered that Mary Hansell Hayes (Hayes) was working on an expired

9 teaching license.
1 O After review of the matters alleged, Hayes and the Commission agree that their
1 1 respective interests, together with the public interest, are best served by a stipulation to
12 certain facts and the imposition of a Public Reprimand.
13 By signing below, Hayes acknowledges, understands, stipulates, and agrees to the
14 following: (i) she has been fully advised of her rights to notice and a hearing to contest
15 the findings of fact, conclusions of law, and order set forth below, and fully and finally
16 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of
17 Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation

. 13 and Final Order is a public document and disclosed to the public upon request by the
1 9 Commission; (iii) this Stipulation and Final Order is confingent upon and subject to
20 approval and adoption by the Commission. Ifthe Commission does not approve and
21 adopt this Stipulation and Final Order, then neither Hayes nor the Commission are
22 bound by the terms herein; (iv) she has fully read this Stipulation and Final Order, and
23 understands it completely; (v) she voluntarily, without any force or duress, enters into
24 this Stipulation and Final Order and consents to issuance and entry of the Stipulated
25 Final Order below; (vi) she states that no promise or representation has been made to
26 induce her to sign this Stipulation and Final Order; and (vii) she has consulted with an
27 attorney regarding this Stipulation and Final Order and has been fully advised with
28 regard to her rights thereto, or waives any and all rights to consult with an attorney prior
29 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated
30 Final Order below.

1 STIPULATION OF FACTS
2 1. The Commission has licensed Hayes since September 28, 2005. Hayes currently
3 holds an Initial I Teaching License, with endorsements in Multiple Subjects, and
4 Special Education ECE, ELE, issued August 26, 2009 and Valid through
5 November 22, 2012. During all relevant times Hayes worked for the Canby
6 School District.
7 2. On November 22, 2008 Hayes’ Initial I Teaching License expired. The
8 Commission received Hayes’ application for renewal on April 6, 2009. The
9 Canby School District requested an Emergency Teaching License to allow Hayes
1O to complete the school year.
1 1 3. During the time Hayes’s license was expired she continued to teach in the Canby
12 School District.
13 4. Subsequently, Hayes took all steps necessary for renewal of her Initial I Teaching
14 License. The Commission renewed Hayes’ Initial I Teaching license effective
15 August 26, 2009.

24 CONCLUSION OF LAW
25 Mary Hansel Hayes served without an active license from November 22, 2008,
26 until April 2, 2009. This conduct constitutes Gross Neglect of Duty in violation of OAR
27 584-020-oo4o(4)(r) (Knowingly working without a license) and OAR 584-020-
28 oo4o(4)(n) as it incorporates OAR 584-020-0010(5) (Use professional judgment), and
29 OAR 584-020-0040(4)(o) as it incorporates OAR 584-020-0035(2)(a) (Apply for,
3O accept, offer, or assign a position of responsibility only on the basis of professional
31 qualifications, and will adhere to the conditions of a contract or the terms of the
32 appointment). The Commission’s authority to impose discipline in this matter is based
33 upon ORS 342.175.
