' 1 ‘ JUN 1 5 2912 1 BEFORE THE TEACHER STANDARDS AND PRACTICES commesrorigtli“ 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF SUSPENSION 5 ANDREW ISAIAH HUNT ) 6 On or about April 19, 2011, the Teacher Standards and Practices Commission 7 (Commission) received reports indicating that Mr. Hunt may have engaged in conduct constituting 8 gross neglect of duty. 9 The Commission charged Mr. Hunt with gross neglect 0f duty and issued a Notice of 10 Opportunity for Hearing on September 19, 2011. After review of the matters alleged, Mr. Hunt and 11 the Commission agree that their respective interests, together with the public interest, are best 12 served by a stipulation to certain facts and the imposition of a suspension of his teaching license. 13 By signing below, Mr. Hunt acknowledges, understands, stipulates, and agrees to the 14 following: (i) he has been fully advised of his rights to notice and a hearing to contest the findings 15 of fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and 16 any rights to appeal or othenrvise challenge this Stipulation of Facts, and Order of Suspension 17 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and 18 disclosed to the public by the Commission upon request; (iii) this Stipulation and Final Order is 19 contingent upon and subject to approval and adoption by the Commission. if the Commission 20 does not approve and adopt this Stipulation and Final Order, then neither Mr. Hunt nor the 21 Commission are bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, 22 and understands it completely; (v) he voluntarily, without any force or duress, enters into this 23 Stipulation and Final Order and consents to issuance and entry of the Stipulated Final Order 24 below; (vi) he states that no promises or representations have been made to induce him to sign 25 this Stipulation and Final Order; and (vii) he has consulted with an attorney regarding this 26 Stipulation and Final Order and has been fully advised with regard to his rights thereto, or waives Page 1 STIPULATION OF FACTS, ORDER OF SUSPENSION — HUNT, ANDREW 1 any and all rights to consult with an attorney prior to entering into this Stipulation and Final Order 2 and issuance and entry of the Stipulated Final Order below. 3 STIPULATION OF FACTS 4 1. The Commission has licensed Mr. Hunt since February 23, 2005. Mr. Hunt currently 5 holds an Initial I Teaching License with endorsements in Art ML/HS, Multiple Subjects MIDLVL, 6 and Social Studies HS/ML, issued March 27, 2008 and was valid through March 26, 2011. He 7 timely applied for renewal of his license which application is pending. He has had no prior 8 disciplinary action taken by the Teacher Standards and Practices Commission. 9 2. Mr. Hunt was employed by the Salem-Keizer School District from 2005 until June 2011 10 when he was laid off. He worked as a high school teacher at North Salem High School at all 11 relevant times. He has continued to substitute teach for the Salem-Keizer District since that time 12 under his current Iicensure. 13 3. While employed at North Salem High School, Mr. Hunt used school district computers 14 and internet connections in furtherance of his personal photography business on one or more 15 occasions and for his personal interests in a photography club on several occasions. He used a 16 school computer during school hours on at least two occasions to distribute his own fictional stories 17 to individuals outside of the school. 18 4. In February of 2010, Mr. Hunt invited a photographer to speak to his photography 19 students. ln preparation for this photographer's presentation, Mr. Hunt utilized school district 20 computers to download images from the photographer's website without verifying the content of 21 the images. Three pages of the downloaded images contained sexually explicit content that 22 remained stored on the school computer as Mr. Hunt failed to remove the images when he 23 discovered the content. By engaging in the conduct in paragraph 3 above, Andrew l. Hunt engaged in gross neglect of 9 duty in violation of ORS 342.175, OAR 584-020-0040(4)(n) as it OAR 584-020-0010(5) (Use of 10 professional judgment); OAR 584-020-0025(2)(e) (Using district lawful and reasonable rules and 1 1 regulations); and OAR 584-020~0040(4)(b) (Knowing and substantial unauthorized use of employment 12 time or school resources for private purposes). 13 2. By engaging in the conduct in paragraph 4 above, Andrew I. Hunt engaged in gross neglect of 14 duty in violation of ORS 342.175, OAR 584-020-0040(4)(n) as it OAR 584-020-0010(5) (Use professional 15 judgment); and OAR 584-020-0040(4)(q) (Knowing and unauthorized use of school computer equipment 16 to receive, store, produce or send sexually explicit materials). 17 3.
