1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND FINAL ORDER 5 GREGG ALAN FEHR ) OF REPRIMAND 6 On or about February 27, 2008, the Teacher Standards and Practices Commission 7 (Commission) received information that Gregg Alan Fehr (Fehr) was convicted in 1980 of two 8 counts of Theft ll (a Class A Misdemeanor), which Mr. Fehr had failed to disclose on two 9 applications for licensure. Mr. Fehr has been licensed by the Commission since June 7, 2004. 10 Mr. Fehr fully cooperated with the Commission's investigation. After review of the 11 matters alleged, Mr. Fehr and the Commission agree that their respective interests, together 12 with the public interest, are best served by a stipulation to certain facts and a public reprimand. 13 This document sets forth the facts upon which the parties have agreed and the 14 stipulated sanction to be imposed. Mr. Fehr stipulates that there is sufficient evidence in the 15 Commissions files and records to support the findings of fact, conclusions of law, and order set 16 forth below. 17 By signing below, Mr. Fehr acknowledges, understands, stipulates, and agrees to the 18 following: (i) he has been fuIIy advised of his rights to notice and a hearing to contest the 19 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 20 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 21 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 22 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and ‘ 23 Final Order is contingent upon and subject to approval and adoption by the Commission. If the ‘ 24 Commission does not approve and adopt this Stipulation and Final Order, then neither Mr. Fehr 25 nor the Commission are bound by the terms herein; (iv) he has fully read this Stipulation and 26 Final Order, and understands it completely; (v) he voluntarily, without any force or duress, PAGE 1 - STIPULATION 0F FACTS AND FINAL ORDER OF REPRIMAND - GREGG ALAN FEHR 1 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated 2 Final Order below; (vi) he states that no promises or representation has been made to induce 3 him to sign this Stipulation and Final Order; and (vii) he has consulted with an attorney 4 regarding this Stipulation and Final Order and has been fully advised with regard to his rights 5 thereto, or waives any and all rights to consult with an attorney prior to entering into this 6 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This 7 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. 8 Mr. Fehr stipulates that there are sufficient facts contained in the Commission’s files and 9 records to support the findings of fact and conclusions of law set forth below. In entering into 10 this stipulation, Mr. Fehr waives the right to a hearing to contest the findings of fact, conclusions 11 of law and order set forth below. 12 STIPULATION OF FACTS 13 1. The Commission has licensed Mr. Fehr since June 7, 2004. Mr. Fehr currently holds 14 an Initial I Teaching License valid August 27, 2007 through November 2, 2010 with an 15 endorsement in special education. He is employed by the Medford School District. 16 2. On February 21, 1980, Mr. Fehr was convicted in Lane County District Court of two 17 counts of Theft II, a Class A Misdemeanor. 18 3. This conduct constitutes Gross Neglect of 4 Duty in violation of OAR 584~020-0040(4)(c) (Knowing falsification or misrepresentation) and 5 OAR 584»020-0040(4)(n) as it incorporates OAR 584-020-0010(5) (Use professional judgment). 6 The Commission has the authority to impose discipline in this matter under ORS 342.120 7 through 342.430 and OAR Chapter 584. 8 FINAL ORDER 9 The Commission adopts and incorporates herein the above finding of facts, 10 conclusions of law, and based thereon, imposes a Public Reprimand on Gregg Alan Fehr.
