1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND FINAL ORDER OF 5 FORREST DEAN MCKINNIS ) SUSPENSION E73 On November 17, 2008, the Teacher Standards and Practices Commission 8 (Commission) received a report from Morrow County School District indicating that Forrest Dean 9 McKinnis (McKinnis) sold school district text books without permission and used the funds 10 received for personal purposes. 1 1 After review of the matters alleged, Mr. McKinnis and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to certain 13 facts and the imposition of a ninety day suspension and four years of probation to commence 14 upon reinstatement. 15 By signing below, Mr. McKinnis acknowledges, understands, stipulates, and agrees to 16 the following: (i) he fully and finally waives all rights to notice and a hearing to contest the 17 findings of fact, conclusions of law, and order set forth below, and any rights to appeal or 18 othenlvise challenge this Stipulation of Facts, Order of Suspension (Stipulation and Final Order); 19 (ii) this Stipulation and Final Order is a public document and disclosed to the public upon 20 request by the Commission; (iii) this Stipulation and Final Order is contingent upon and subject 21 to approval and adoption by the Commission. If the Commission does not approve and adopt 22 this Stipulation and Final Order, then neither Mr. McKinnis nor the Commission are bound by 23 the terms herein; (iv) he has fully read this Stipulation and Final Order, and understands it 24 completely; (v) he voluntarily, without any force or duress, enters into this Stipulation and Final 25 Order and consents to issuance and entry of the Stipulated Final Order below; (vi) he states that 26 no promises or representation has been made to induce him to sign this Stipulation and Final 27 Order; and (vii) he has consulted with an attorney regarding this Stipulation and Final Order and 28 has been fully advised with regard to his rights thereto, or waives any and all rights to consult Page 1 STIPULATION OF FACTS ORDER OF SUSPENSION - MCKINNIS 1 with an attorney prior to entering into this Stipulation and Final Order and issuance and entry of 2 the Stipulated Final Order below. 3 STIPULATION 0F FACTS 4 1. The Commission has licensed Mr. McKinnis since July 21, 2004. Mr. McKinnis holds an 5 Initial l Teaching License, authorized to teach health at the high school level, issued July 6 20, 2006, and valid through August 12, 2009. 7 2. Mr. McKinnis, while employed as a teacher and alternative education director in the 8 Morrow County School District, took forty-three district owned text books from the 9 Morrow Education Center without permission, sold the books through Ebay and used the 10 money he received from the sale of these books for personal purposes. 11 3. This conduct constitutes Gross Neglect of Duty in violation of 26 OAR 584-020-0040(4)(a) and Gross Unfitness in violation of OAR 584-020-0040(5)(c). The 27 Commission's authority to impose discipline in this matter is based upon ORS 342.175. 28 /// Page 2 STIPULATION OF FACTS ORDER OF SUSPENSION - MCKINNIS 1 ORDER 2 The Initial l Teaching License of Forrest Dean McKinnis is suspended for a period of 3 ninety days from the date of this order. Upon reinstatement Mr. McKinnis will be placed on 4 probation for a period of four years.
