MAJEED-PAULEY ) LICENSE REVOCATION 7 8 9 On March 23, 2010, the Teacher Standards and Practices Commission 10 (Commission) issued a Notice of Opportunity for Hearing to Raushanna Z. Majeed- 11 Pauley (Majeed-Pauley) in which the Commission charged her with Gross Neglect of 12 Duty pursuant to OAR 584-020-0040(5)(d). The Notice was sent via U.S. First Class 13 Mail and U.S. Certified Mail Receipt 7009 1410 0002 1925 4720 to the address on file 14 with the Commission. Ms. Majeed-Pauley signed for the Notice on March 26, 2010. 15 The Notice of Opportunity of Hearing, dated March 23, 2010, and signed by Victoria 16 Chamberlain, Executive Director, stated: 17 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY 18 PERIOD. YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED 19 UNLESS YOUR FAILURE TO REQUEST A HEARING WAS BEYOND YOUR 2O REASONABLE CONTROL. IF YOU DO NOT REQUEST A HEARING OR IF 21 YOU FAIL TO APPEAR AT A HEARING, THE COMMISSION WILL ADOPT AN 22 ORDER OF DEFAULT WHICH MAY INCLUDE THE REVOCATION OR 23 SUSPENSION OF YOUR LICENSE OR OTHER DISCIPLINE.” 24 25 Ms. Majeed-Pauley did not request a hearing. The Commission, therefore, finds Ms. 26 Majeed-Pauley to be in default and enters the following findings of fact, conclusions of 27 law and order, based on the files and records of the Commission concerning this matter. 28 FINDINGS OF FACT 29 1. The Commission has licensed Ms. Majeed-Pauley as a teacher in Oregon since 30 October 1, 2004. Her current Restricted Substitute Teaching License, issued October 31 2, 2007, expires on October 1, 2010. During all relevant times, she was employed as a 32 substitute teacher in the Central School District. 33 2. Ms. Majeed-Pauley was arrested for various offenses in Cleveland, Ohio on August 4, 34 1969; Buffalo, New York on January 31, 1970; Highland Hills, Ohio on February 2, PAGE 1-DEFAULT ORDER OF LICENSE REVOCATION - RAUSHANNA z. MAJEED-PAULEY 1 1970; Cleveland, Ohio on May 16, 1970; Atlanta, Georgia on October 1, 1971; and 2 Cleveland, Ohio on October 12, 1971, and December 6, 1971. 3 3. Ms. Majeed-Pauley’s October 1, 1971, arrest resulted in a conviction for Loitering for the 4 Purpose of Prostitution. 5 4. On October 12, 1971, and December 6, 1971, Ms. Majeed-Pauley was arrested for and 6 subsequently convicted of Forgery. 7 5. On or about September 29, 2004, Ms. Majeed-Pauley signed and submitted an 8 Application For Educator License Form C-1. She answered “no” to question number 8, 9 “Have you ever been convicted or been granted conditional discharge by any court for: 10 (a) any felony; (b) misdemeanor; or (c) any major traffic violation, such as: driving 11 under the influence of intoxicants or drugs; reckless driving; fleeing from or attempting 12 to elude a police officer; driving while your license was suspended, revoked or used in 13 violation of any license restriction; or failure to perform the duties of a driver or witness 14 at an accident?" She signed and submitted renewal applications on August 9, 2006, 15 and August 15, 2007. She answered “no” to question 8 on each of these applications. 16 These answers were false; Ms. Majeed-Pauley failed to disclose any of her arrests 17 between 1969 and 1971. 18 CONCLUSIONS OF LAW 19 Ms. Majeed-Pauley’s conviction for Forgery constitutes gross unfitness in 20 violation of OAR 584-020-0040(5)(c) (Conviction of violating any federal, state, or local 21 law. A conviction includes any final judgment of conviction by a court whether as the 22 result of guilty plea, no contest plea or any other means.) Ms. Majeed-Pauley’s failure 23 to correctly answer the character questions on her initial application and renewal 24 application constitute gross neglect of duty in violation of OAR 584-020-0040(4)(c) 25 (Knowing falsification of any document or knowing misrepresentation directly related to 26 licensure, employment, or professional duties). 27 Furthermore, pursuant to OAR 584-020-0040, the Commission will revoke the 28 license of any educator who has been convicted of any of the crimes listed in ORS PAGE 2-DEFAULT ORDER OF LICENSE REVOCATION - RAUSHANNA z. MAJEED-PAULEY 1 342.143, or the substantial equivalent of any of those crimes if convicted in another 2 jurisdiction. Ms. Majeed-Pauley’s 1971 conviction for Prostitution constitutes gross 3 unfitness pursuant to OAR 584-020-0040(5)(d) because it is substantially equivalent to 4 OAR 167.007 (Prostitution) a crime listed in OAR 584-020-0040(1). The Commissions 5 authority to impose discipline in this matter is based upon ORS 342.175. 6 /// 7 FINAL ORDER 8 The Commission hereby revokes Raushanna Z.
