1 BEFORE THE 2 TEACHER STANDARDS AND PRACTICES COMMISSION 3 OF THE STATE OF OREGON g ln the Matter of the ) 6 Teaching License of ) DEFAULT ORDER OF 7 HANNAH JO WEBB ) REVOCATION OF LICENSE 3 10 On April 15, 2010, the Teacher Standards and Practices Commission (Commission) 11 issued a Notice of Opportunity for Hearing to Hannah Jo Webb (Webb) in which the 12 Commission charged her with Gross Neglect of Duty and Gross Unfitness pursuant to OAR 13 584-020-0040(4)(n), OAR 584-020-0010(5), OAR 584-020-0040(4)(p), OAR 584-020- 14 0040(5)(c), OAR 584-020-0040(5)(e) and OAR 584-050-0036(3)(d). Notice was sent via U.S. 15 First Class Mail and U.S. Certified Mail Receipt 7009 1410 0002 1925 4812 to the address on 16 file with the Commission. The Certified Mail was eventually returned to the Commission, 17 however the regular mail was not, indicating that the address on file was correct. The Notice of l8 Opportunity of Hearing, dated April 15 2010, and signed by Victoria Chamberlain, Executive 19 Director, stated: 20 “If a request for hearing is not received within this 21-day period, your right to a hearing 21 shall be considered waived unless your failure to request a hearing was beyond your 22 reasonable control. If you do not request a hearing or if you fail to appear at a hearing, 23 the Commission will adopt an order of default which may include the revocation or 24 suspension of your license or other discipline." 52 Ms. Webb did not request a hearing. The Commission, therefore, finds Ms. Webb to be 27 in default and enters the following findings of fact, conclusions of law and order, based on the 28 files and records of the Commission concerning this matter. 29 FINDINGS 0F FACT 30 1. On March 27, 2009, Hannah Webb was convicted of Illegally Disposing of Fetal Remains in the 31 Superior Court of California, Placer County. 32 2. The circumstances that gave rise to this conviction were that on the evening of July 22, 2007, 33 Ms. Webb gave birth to a baby girl in the bathroom of a friend's home. Ms. Webb stated that 34 she did not check to see if the baby was breathing, but thought it was still born. Ms. Webb 35 disposed of the child and evidence of the birth in the apartment complex dumpster. Ms. Webb 36 carried the baby to full term, but maintained to authorities that she did not know that she was 37 pregnant. 38 3. The Commission attempted to contact Ms. Webb several times to arrange an investigative 39 interview. To date she has not responded to these requests. PAGE 1—DEFAULT ORDER 0F LICENSE REVOCATION - WEBB, HANNAH JO 1 CONCLUSIONS OF LAW 2 Hannah Jo Webb's conviction constitutes gross unfitness and gross neglect of duty in violation 3 of ORS 342.175(1)(c) and ORS 342.175(1)(b); OAR 584-020-0040(5)(c) (Conviction of violating any 4 federal, state, or local law. A conviction includes any final judgment of conviction by a court‘ whether as I 5 the result of guilty plea, no contest plea or any other means. ), and OAR 584-020-0040(4)(n) as it 6 incorporates OAR 584-020-0010(5) (Use professional judgment). Ms. Webb's conduct giving rise to 7 the conviction constitutes gross unfitness and gross neglect of duty in violation of ORS 342.175(1)(c) 8 and ORS 342.175(1)(b); OAR 584-020-0040(5)(e) (Admission of or engaging in acts constituting 9 criminal conduct, even in the absence of a conviction), OAR 584-020-0040(4)(n) as it incorporates OAR 10 584-020-0010(5) (Use professional judgment); and OAR 584-050-0006(3)(d) (The Executive Director 11 has evidence that the applicant may lack fitness to serve as an educator). Ms. Webb's failure to 12 participate in the investigatory process constitutes gross neglect of duty in violation of ORS I3 342.175(1)(b) and OAR 584-020-0040(4)(p) (Subject to the exercise of any legal right or privilege, 14 failure or refusal by an educator under investigation to respond to requests for information, to furnish 15 documents or to participate in interviews with a Commission representative relating to a Commission l6 investigation).
