1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 0F THE STATE OF OREGON 3 ln the Matter of the ) STlPULATION OF FACTS, 4 Teaching License OI ) FINAL ORDER OF REPRIMAND 5 LASHELL RENA HOLTON ) 6 On or about May 1, 2009, the Teacher Standards and Practices Commission 7 (Commission) referred LaShell Rena Holton (Holton) to investigation after discovering that she 8 was teaching outside the scope oi her license. 9 After review of the matters alleged, Holton and the Commission agree that their 10 respective interests, together with the public interest, are best served by a stipulation to certain 11 facts and the imposition of a Public Reprimand. I > 12 This document sets forth the facts upon which the parties have agreed and the 13 stipulated sanction to be imposed. Holton stipulates that there is sufficient evidence in the 14 Commission's files and records to support the findings of fact, conclusions of law, and order set 15 forth below. '16 By signing below, Holton acknowledges, understands, stipulates, and agrees to the 17 ionowmg: (i) ‘she has been fully advised or her ‘rights to’ notice ‘and a nearing to contest me‘ I 18 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all, 19 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts, Final Order 20 of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 21 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and 22 Final Order is contingent upon and subject to approval and adoption by the Commission. lf the 23 Commission does not approve and adopt this Stipulation and Final Order, then neither Holton 24 nor the Commission are bound by the terms herein; (iv) she has fully read this Stipulation and 25 Final Order, and understands it completely; (v) she voluntarily, without any force or duress, 26 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated 27 Final Order below; (vi) she states thatno promises or representation has ‘been made to induce 28 him to sig'n'this Stipulation and Final Order; and (vii) she hasconsulted with‘ an attorney Page 1 STIPULATION OF FACTS, FINAL ORDER OF REPRIMAND -HOLTON 1 regarding this Stipulation and Final Order and has been fully advised with regard to her rights 2 thereto, or waives any and all rights to consult with an attorney prior to entering into this 3 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This 4 stipulation is contingent upon approval and adoption of the Order by the Commission. If the 5 Commission does not adopt this Order, neither Holton nor the Commission are bound by these 6 Stipulations and Holton retains all rights to a hearing on the allegations. 7 STIPULATION 0F FACTS 8 1. The Commission has licensed Ms. Holton since June 22, 2006. Ms. Holton currently 9 holds an Initial ll Teaching License authorized to teach Multiple Subjects, issued 10 December 4, 2009, and valid through December 3, 2012. Ms. Holton also holds a 11 Conditional Permit authorizing her to teach Special Education in the Portland Public 1 2 School District. 13 2. On November 20, 2008 the Commission issued Ms. Holton an Emergency Teaching 14 License, with an endorsement in Special Education, valid until December 30, 2008. 15 3. Ms. Holton continued to teach Special Education following the expiration of her i=6 emergency license on December 30, 2008, through the May 1, 2009 issuance of a 17 Conditional Assignment permit with an endorsement in Special Education. 18 IT IS SO S IPU ATED AND AGRE D TO: 19 ‘v LL, :1 ‘.2 M 20 . This conduct 4 constitutes gross neglect of duty in violation of ons 342.175(1)(b); OAR 584-020-0040(4)(r) 5 (Knowingly working without a license), and OAR 584-020-0040(4)(n) as it incorporates OAR 6 584-020-0010(5) (Use professional judgment).
