6 On or about September 23, 2012 the Teacher Standards and Practices Commission

7 (Commission) received information that Margaret Ann Blair (Blair) had violated relevant standards

8 for competent and ethical performance of Oregon educators.

9 Blair fully cooperated with the Commission's investigation in this matter. After review of the
1O matters alleged, Blair and the Commission agree that their respective interests, together with the
1 1 public interest, are best served by a stipulation to certain facts, the imposition of Public Reprimand of
12 her educator license.
13 This document sets forth the facts upon which the parties have agreed and the stipulated
14 sanction to be imposed. Blair stipulates that there is suflicient evidence in the Commission’s files and
15 records to support the findings of fact, conclusions of law, and order set forth below.
16 By signing below, Blair acknowledges, understands, stipulates, and agrees to the following: (i)
17 she has been fully advised of her rights to notice and a hearing to contest the findings of fact,
18 conclusions of law, and order set forth below, and fully and finally waives all such rights and any rights
19 to appeal or otherwise challenge this Stipulation of Facts and Final Order of Public Reprimand
2O (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed
21 to the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent
22 upon and subject to approval and adoption by the Commission. If the Commission does not approve
23 and adopt this Stipulation and Final Order, then neither Blair nor the Commission are bound by the
24 terms herein; (iv) she has fully read this Stipulation and Final Order, and understands it completely;
25 (v) she voluntarily, without any force or duress, enters into this Stipulation and Final Order and

1 26 consents to issuance and entry of the Stipulated Final Order below; (vi) she states that no promises or
i 27 representation has been made to induce her to sign this Stipulation and Final Order; and (vii) she has
28 consulted with an attorney regarding this Stipulation and Final Order and has been fully advised with

1 regard to her rights thereto, or waives any and all rights to consult with an attorney prior to entering
2 into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below.
3 STIPULATION OF FACTS
4 1) The Commission has licensed Blair since July 26, 2005. Blair currently holds an Initial
5 Administrator license issued July 8, 2013, with an endorsement in Administrator (ALL LVL)
6 which expires on October 3o, 2014. During all relevant times, Blair was employed by the Lebanon
7 School District.
8 2) On September 23, 2012, the Commission received information during the course of another
9 invesn'gation, indicating Blair may have committed acts which constitute gross neglect of duty,
1 O specifically failure to report suspected child abuse.
1 1 3) On or about November 2011, the Commission investigated a report from a patron of the Lebanon
12 School District. The report alleged that in 2006 — 2007, a former Lebanon student and a former
13 Lebanon teacher had engaged in an inappropriate, sexual relationship. The involved educator was
14 eventually convicted of Sex Abuse Three and subjected to Commission discipline.
15 4) During the course of the investigation mentioned in section two (2) above, the Commission
16 became aware that during the 2006-2007 school year, Blair had received reports from patrons and
1 7 staff regarding inappropriate behavior on the part of the involved educator. At the time, Blair held
1 8 the position of principal and was the direct supervisor of the involved educator. During the course
19 of Blair’s investigation into the reports, Blair learned that the educator had been seen giving the
20 involved student a shoulder massage while alone in the classroom. At the time of the massage
21 incident, the lights were out in the classroom and the blinds were shut. Blair learned that the
22 educator had taken the student to a movie with another student. Blair learned that female students
23 had experienced “crushes” on the involved educator. Blair learned that one female student had
24 stated, “When I graduate I would have sex with him” (involved teacher). At no time did Blair
25 report the information to DHS or law enforcement as required by the Child Abuse Mandatory
26 Reporting law.
27 5) Blair also failed to report what she learned of the conduct described in paragraph four (4) to the
28 Commission as a potential violation of Commission’s statutes and rules.

2 CONCLUSIONS OF LAW
3 The above conduct described in section four (4) above constitutes gross neglect of duty in
4 violation of ORS 342.175(1)(b); OAR 584-o2o-oo4o(4)(n) as it incorporates OAR 584-020-001o(5)
5 (Use professional judgment), OAR 584-020-0025(2)(e) (Using district lawful and reasonable rules
6 and regulations); and OAR 584-020-0040(4)(s) (Failing t0 report child abuse pursuant to ORS
7 4198.010).
8 The above conduct described in section five (5) above constitutes gross neglect of duty in
9 violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-020-oo1o(5)
l 10 (Use professional judgment), OAR 584-020-oo4o(4)(m), OAR 584-020-0041(1) to (3)(Failing to
i 1 1 report conduct that may constitute Gross Neglect 0f Duty).
i 12 The Commission's authority to impose discipline in this matter is based upon ORS 342.175.

14 The Commission hereby adopts and incorporates herein the above stipulation of facts,
15 conclusions of law, and based thereon hereby imposes a Public Reprimand on the educator license of
16 Margaret Ann Blair following the adoption of this order.
