g On or about May 1, 2009 the Teacher Standards and Practices Commission

8 (Commission) referred Ruth Irene Frieboes (Frieboes) to investigation for teaching on an

9 expired license.
10 After review of the matters alleged, Frieboes and the Commission agree that
11 their respective interests, together with the public interest, are best served by a
12 stipulation to certain facts and the imposition of a Public Reprimand.
13 By signing below, Frieboes acknowledges, understands, stipulates, and agrees
14 to the following: (i) she has been fully advised of her rights to notice and a hearing to
15 contest the findings of fact, conclusions of law, and order set forth below, and fully and
16 finally waives all such rights and any rights to appeal or otherwise challenge this
17 Stipulation of Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this
18 Stipulation and Final Order is a public document and disclosed to the public upon
19 request by the Commission; (iii) this Stipulation and Final Order is contingent upon and
20 subject to approval and adoption by the Commission. If the Commission does not
21 approve and adopt this Stipulation and Final Order, then neither Frieboes nor the
22 Commission are bound by the terms herein; (iv) she has fully read this Stipulation and
23 Final Order, and understands it completely; (v) she voluntarily, without any force or
24 duress, enters into this Stipulation and Final Order and consents to issuance and entry
25 of the Stipulated Final Order below; (vi) she states that no promise or representation has
26 been made to induce her to sign this Stipulation and Final Order; and (vii) she has
27 consulted with an attorney regarding this Stipulation and Final Order and has been fully
28 advised with regard to her rights thereto, or waives any and all rights to consult with an

1 attorney prior to entering into this Stipulation and Final Order and issuance and entry of
2 the Stipulated Final Order below.
3 STIPULATION OF FACTS
4 1. The Commission has licensed Frieboes since November 30, 2005. Frieboes
5 currently holds a Charter School Registry, with an endorsement in Language Arts
6 (HS, ML), issued September 17, 2009 and valid through September 17, 2012.
7 2. Frieboes’ previous license, a Three Year Career and Technical Education
8 Teaching License expired on November 20, 2008. The Commission did not
9 receive her application for a Charter School Registry until August 19, 2009.
10 Frieboes continued to teach in the North Powder Charter School following, the
11 expiration of her license.

22 CONCLUSION OF LAW
23 Frieboes continued to teach following the expiration of her license as described
24 in paragraph 2 above. This conduct constitutes Gross Neglect of Duty in violation of
25 OAR 584~020-0040(4)(4) (Knowingly working without a license).
26 The Commission's authority to impose discipline in this matter is based upon
27 ORS 342.175.

2 The Commission hereby imposes a Public Reprimand on the licensure of Ruth
3 Irene Frieboes.
