7 On April 7 2010 Mr. Gabriel was internally referred for investigation regarding
8 him working without a valid teaching license of charter school registration.
9 After review of the matters alleged, Gabriel and the Commission agree that their
1O respective interests, together with the public interest, are best served by a stipulation to
1 1 certain facts and the imposition of a public reprimand
12 By signing below, Gabriel acknowledges, understands, stipulates, and agrees to
13 the following: (i) he has been fully advised of his rights to notice and a hearing to contest
14 the findings of fact, conclusions of law, and order set forth below, and fully and finally
15 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of
16 Facts and Final Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation
17 and Final Order is a public document and disclosed to the public upon request by the
18 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to
19 approval and adoption by the Commission. If the Commission does not approve and
20 adopt this Stipulation and Final Order, then neither Gabriel nor the Commission are
21 bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, and
, 22 understands it completely; (v) he voluntarily, without any force or duress, enters into
23 this Stipulation and Final Order and consents to issuance and entry of the Stipulated
24 Final Order below; (vi) he states that no promise or representation has been made to
25 induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an
26 attorney regarding this Stipulation and Final Order and has been fully advised with
27 regard to his rights thereto, or waives any and all rights to consult with an attorney prior
28 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated
29 Final Order below. Gabriel understands that the probation will be subject to specific
30 terms and conditions.
31 STIPULATION OF FACTS
32 1. Mr. Gabriel has been licensed as a teacher in Oregon since April 12, 2006. He received an
33 Emergency Teaching License, with an endorsement in Music, August 23, 2010 that was valid
34 until October 30, 2010. Mr. Gabriel was issued his current Charter School Registration on
35 November 302, 2010 that expires on February 12, 2014. At all material times Mr. Gabriel
36 was employed by the MITCH Charter School.

1 2. Mr. Gabriel was issued a Charter School Registry on April 12, 2006. That credential expired j
2 on April12, 2009. Mr. Gabriel continued to teach after the credential expired. l

12 CONCLUSION OF LAW
13 Chris Gabriel's conduct constituted Gross Neglect of Duty in violation of ORS
14 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584-o2o-ooio(5) (Use
l 15 professional judgment), OAR 584-020—oo40(4)(o) as it incorporates OAR 584-020-
‘ 16 0035(2)(a) (Apply for, accept, offer, or assign a position of responsibility only on the
3 17 basis of professional qualifications, and will adhere to the conditions of a contract or
i 18 the terms of the appointment).
, 19 The Commission's authority to impose discipline in this matter is based upon
. 20 ORS 342.175.

22 The Commission adopts and incorporates herein the above findings of fact and
23 conclusions of law, and based thereon, imposes a Public Reprimand on Chris Gabriel’s
‘ 24 Standard Teaching License.
