v _" 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) SURRENDER AND REVOCATION 5 TAYLOR, JASON ) OF LICENSURE 6 On or about November 8, 2010, the Teacher Standards and Practices Commission 7 (Commission) received a report from Paula Radich, Superintendent, Newberg School District, 8 indicating that licensed educator, Jason Taylor (Taylor), had committed acts of unprofessional i 9 conduct. Specifically, Taylor had failed to maintain professional boundaries with a female 10 student during the 2009-10 school year. While conducting an investigation into the November i 1 1 8, 2010 complaint; TSPC received additional information from Radich regarding Taylor. This 12 second complaint against Taylor, received on June 20, 2012, indicated additional boundary 13 issues involving alcohol, sexual contact with former female students and unprofessional conduct 14 during a school sponsored trip to New York. 15 After review of the matters alleged, Taylor and the Commission agree that their 16 respective interests, together with the public interest, are best served by a stipulation to certain 17 facts, Surrender and Revocation of Taylor’s Oregon Teaching license. 18 This document sets forth the facts upon which the parties have agreed and the stipulated 19 sanction to be imposed. Taylor stipulates that there is sufficient evidence in the Commissions 20 files and records to support the findings of fact, conclusions of law, and order set forth below. 21 By signing below, Taylor acknowledges, understands, stipulates, and agrees to the 22 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 23 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 24 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 25 Order of Surrender and Revocation of Licensure (Stipulation and Final Order); (ii) this 26 Stipulation and Final Order is a public document and disclosed to the public upon request by the 27 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to approval Page 1 STIPULATION OF FACTS, ORDER OF SURENDER AND REVOCATION — JASON TAYLOR 1 and adoption by the Commission. If the Commission does not approve and adopt this 2 Stipulation and Final Order, then neither Taylor nor the Commission are bound by the terms 3 herein; (iv) he has fully read this Stipulation and Final Order, and understands it completely; (v) 4 he voluntarily, without any force or duress, enters into this Stipulation and Final Order and 5 consents to issuance and entry of the Stipulated Final Order below; (vi) he states that no 6 promises or representation has been made to induce him to sign this Stipulation and Final 7 Order; and (vii) he has consulted with an attorney regarding this Stipulation and Final Order 8 and has been fully advised with regard to his rights thereto, or waives any and all rights t0 9 consult with an attorney prior to entering into this Stipulation and Final Order and issuance and 10 entry of the Stipulated Final Order below. This Order sets forth the facts upon which the parties 1 1 have agreed and the sanction to be imposed. Taylor stipulates that there are sufficient facts 12 contained in the Commission’s files and records to support the findings of fact and conclusions 13 of law set forth below. In entering into this stipulation, Taylor waives the right to a hearing to 14 contest the findings of fact, conclusions of law and order set forth below. 15 STIPULATION OF FACTS 16 1. The Commission has licensed Taylor since July 22, 2008. Taylor currently holds an 17 Initial I Teaching license with an endorsement in Music (ML/ HS), issued July 22, 2008, 1 8 and expired on February 27, 2012. On February 6, 2012, TSPC received Taylor’s timely , 19 application for renewal and his licensure status was adjusted to “Expiration Pending”. 20 2. Between November 8, 2010, and June 20, 2012, the Commission received information 21 from the Newberg School District indicating Taylor had committed acts of I 22 unprofessional conduct. ‘ i 23 3. Investigations by TSPC, the school district and local law enforcement identified the i 24 following unprofessional conduct on the part of Taylor: 25 a. On December 3, 2011, Taylor escorted a former student to an event as his date. The 26 former student was 19 years of age at the time. Page 2 STIPULATION OF FACTS, ORDER OF SURENDER AND REVOCATION — JASON TAYLOR 1 b. Taylor furnished this minor with alcohol at this event and again later that evening at 2 his residence. Taylor engaged in sexual contact with this former student that same ‘ 3 evening. i 4 4. 0n May 21, 2012, Taylor was arrested and charged with ORS 471.410; “Providing Liquor l 5 to a Minor”. Taylor later pled no contest, in the Newberg Municipal Court of Yamhill 6 County, to the charge as a “violation” as part of a plea agreement that included the 7 requirement to surrender his teaching license. This 17 conduct constitutes Gross Neglect of Duty in violation of ORS 342.175(1)(b); OAR 584-020- 18 oo4o(4)(n) as it incorporates OAR 584-020-001o(5) (Use professional judgment). This conduct 19 also constitutes gross unfitness in violation of ORS 342.175(1)(c); OAR 584-o2o-oo4o(5)(e) 20 (Admission of or engaging in acts constituting criminal conduct, even in the absence of a 21 conviction), specifically ORS 471.410 (Providing Liquor to a Minor). 22 Jason Taylor engaged in unprofessional conduct as described in section #4 above. This 23 conduct constitutes Gross Neglect of Duty in violation of ORS 342.175(1)(b); OAR 584-020- 24 oo4o(4)(n) as it incorporates OAR 584-020-001o(5) (Use professional judgment). This conduct 25 also constitutes gross unfimess in violation of ORS 342.175(1)(c); OAR 584-020-oo4o(5)(c) 26 (Conviction of violating any federal, state, or local law.
