RIDDLE ) SUSPENSION OF RIGHT TO APPLY g On or about January 23, 2009, the Teacher Standards and Practices Commission 8 (Commission) received a report from Klamath County Superintendent Greg Thede that William 9 J. Riddle was being investigated by local law enforcement in connection with an injury to his 10 son. 11 After review of the matters alleged, Mr. Riddle and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to certain 13 facts and the imposition of a one year suspension of his right to apply for a license. 14 By signing below, Mr. Riddle acknowledges, understands, stipulates, and agrees to the 15 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 16 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 17 such rights and any rights to appeal or othewvise challenge this Stipulation of Facts, Order of 18 Suspension of Right to Apply (Stipulation and Final Order); (ii) this Stipulation and Final Order is 19 a public document and disclosed to the public upon request by the Commission; (iii) this 20 Stipulation and Final Order is contingent upon and subject to approval and adoption by the 21 Commission. If the Commission does not approve and adopt this Stipulation and Final Order, 22 then neither Mr. Riddle nor the Commission are bound by the terms herein; (iv) he has fully read 23 this Stipulation and Final Order, and understands it completely; (v) he voluntarily, without any 24 force or duress, enters into this Stipulation and Final Order and consents to issuance and entry 25 of the Stipulated Final Order below; (vi) he states that no promises or representation has been 26 made to induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an 27 attorney regarding this Stipulation and Final Order and has been fully advised with regard to his Page 1 STIPULATION OF FACTS ORDER OF SUSPENSION - RIDDLE 1 rights thereto, or waives any and all rights to consult with an attorney prior to entering into this 2 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. 3 STIPULATION OF FACTS 4 1. The Commission has licensed Mr. Riddle since April 5, 2007. Mr. Riddle last held a 5 Restricted Substitute License that expired on April 5, 2010. 6 2. On December 30, 2008, while riding in his car, Mr. Riddle caused an injury to his 15 year 7 old son. The injury caused his son pain and Ieft a deep bruise on his face. Mr. Riddles conduct described in paragraphs 2 constitutes gross neglect of duty in 3 violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 4 584-020-0010(5) (Use professional judgment) and OAR 584-020-0040t4)(d) 5 (Unreasonable physical force against students, fellow employees, or visitors to the 6 school, except as permitted under ORS 339.250). 7 8 ORDER 9 Based on the foregoing, it hereby ordered as follows: 1O 1.
