1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS. 4 Teaching License of ) SURRENDER AND REVOCATION 5 GEORGE PETER KUHN ) OF LICENSURE 6 On or about August 28, 2009, the Teacher Standards and Practices Commission 7 (Commission) received a phone call from the School Resource Officer advising that Kuhn was 8 under investigation regarding allegations of inappropriately touching a student. 9 After review of the matters alleged, Kuhn and the Commission agree that their 10 respective interests, together with the public interest, are best served by a stipulation to certain 11 facts, Surrender and Revocation of Kuhn’s Oregon Teaching License. 12 This document sets forth the facts upon which the parties have agreed and the 13 stipulated sanction to be imposed. Kuhn stipulates that there is sufficient evidence in the 14 Commission’s files and records to support the findings of fact, conclusions of law, and order set 15 forth below. 16 By signing below, Kuhn acknowledges, understands, stipulates, and agrees to the 17 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 18 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 19 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 20 Order of Surrender and Revocation of Licensure (Stipulation and Final Order); (ii) this 21 Stipulation and Final Order is a public document and disclosed to the public upon request by the 22 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to approval and 23 adoption by the Commission. If the Commission does not approve and adopt this Stipulation 24 and Final Order, then neither Kuhn nor the Commission are bound by the terms herein; (iv) he 25 has fully read this Stipulation and Final Order, and understands it completely; (v) he voluntarily, 26 without any force or duress, enters into this Stipulation and Final Order and consents to 27 issuance and entry of the Stipulated Final Order below; (vi) he states that no promises or Page 1 STIPULATION OF FACTS, ORDER OF SURENDER AND REVOCATION - KUHN 1 representation has been made to induce him to sign this Stipulation and Final Order; and (vii) he 2 has consulted with an attorney regarding this Stipulation and Final Order and has been fully 3 advised with regard to his rights thereto, or waives any and all rights to consult with an attorney 4 prior to entering into this Stipulation and Final Order and issuance and entry of the Stipulated 5 Final Order below. This Order sets forth the facts upon which the parties have agreed and the 6 sanction to be imposed. Kuhn stipulates that there are sufficient facts contained in the 7 Commission‘s files and records to support the findings of fact and conclusions of law set forth 8 below. In entering into this stipulation, Kuhn waives the right to a hearing to contest the findings 9 of fact, conclusions of law and order set forth below. 10 STIPULATION 0F FACTS 11 1. The Commission has licensed Kuhn since August 8, 2007. Kuhn currently holds an 12 Initial I Teaching License issued on February 9, 2009, that expired on February 15, 1 3 201 1 . 14 2. On August 28, 2009, the Commission received information that Kuhn was under 15 investigation regarding allegations that he inappropriately touched a student. 16 3. During the 2008-2009 school year, Mr. Kuhn was employed as a kindergarten teacher at 17 Orchard Hills Elementary School.
