1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AN D 4 Teaching License of ) FINAL ORDER 0F REPRIMAND 5 STACY DAWN MCALLIST ER ) g On or about August 4, 2010, the Teacher Standards and Practices Commission 8 (Commission) received a report from the Superintendent of the Scio School District 9 indicating that Stacy Dawn McAllister (McAllister) may have failed to report a possible 10 ease of child abuse in a timely manner. 11 After review of the matters alleged, McAllister and the Commission agree that 12 their respective interests, together with the public interest, are best sewed by a 13 stipulation to certain facts and the imposition of a Public Reprimand on McAllisters 14 Initial l Teaching License. 15 By signing below, McAllister acknowledges, understands, stipulates, and agrees 16 to the following: (i) she has been fully advised of her rights to notice and a hearing to 17 contest the findings of fact, conclusions of law, and order set forth below, and fully and 18 finally waives all such rights and any rights to appeal or otherwise challenge this 19 Stipulation of Facts and Final Order of Reprimand (Stipulation and Final-Order); (ii) this 20 Stipulation and Final Order is a public document and disclosed to the public upon 21 request to the Commission; (iii) this Stipulation and Final Order is contingent upon and 22 subject to approval and adoption by the Commission. Ifthe Commission does not 23 approve and adopt this Stipulation and Final Order, then neither McAllister nor the 24 Commission are bound by the terms herein; (iv) she has fully read this Stipulation and 25 Final Order, and understands it completely; (v) she voluntarily, without any force or 26 duress, enters into this Stipulation and Final Order and consents to issuance and entry of 27 the Stipulated Final Order below; (vi) she states that no promise or representation has 28 been made to induce her to sign this Stipulation and Final Order; and (vii) she has Page 1 STIPULATION 0F FACTS AND ORDER 0F REPRIMAND - MCALLISTER, STACY DAWN 1 consulted with an attorney regarding this Stipulation and Final Order and has been fully 2 advised with regard t0 her rights thereto, or waives any and all rights to consult with an 3 attorney prior to entering into this Stipulation and Final Order and issuance and entry of 4 the Stipulated Final Order below. 5 ' STIPULATION OF FACTS 6 1. The Commission has licensed Stacy Dawn McAllister as a teacher in Oregon since 7 June 19, 2007. McAflistefs current Initial I Teaching License, with an endorsement 8 in Multiple Subjects Self Contained (ECE, ELE), issued on January 17, 2010, is valid 9 until January 3, 2012. During all relevant times, McAllister was employed by the 10 Scio School District. 11 2. On March 12, 2010, McAllister overheard several female first grade students, 12 including AB, discussing the manner in which AB’s father treated her and hoping 13 that the father would treat her more nicely. On March 15, 2010, McAllister spoke 14 with a parent of one of the girls who reported to McAllister that AB had disclosed 15 that her father spanks her with a belt, drives erratically, and grabs her by the hand. 16 On March 19, 2010, McAllister was contacted by the father of a student who reported 17 that his daughter related that AB's father pulls her hair and pushes her down, is 18 trained to hurt people and would hurt his daughter’s parents. 0n March 23, 2010, 19 you addressed the issues with AB’s father and mother directly.
