On June 17, 2009, the Teacher Standards and Practices Commission (Commission) 11 issued a Notice of Opportunity for Hearing to Michael Cory Krager (Krager) in which the 12 Commission charged him with conviction of a crime listed in ORS 342.143(3). The Notice was 13 sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7008 1140 0002 8580 9348 to the 14 address on file with the Commission. The U.S. Postal Service delivered two notices to Krager, 15 the first on June 26, 2009, and the second on July 6, 2009, in an attempt t0 deliver this certified 16 mail, before returning the certified mail receipt to the Commission on July 8, 2009. The first 17 class mail was not returned to the Commission. The Notice of Opportunity of Hearing, dated 18 June 17, 2009, and signed by Victoria Chamberlain, Executive Director, stated: 19 “You, Michael Cory Krager, are entitled to a hearing on the proposed action of the 20 Commission. If you want a hearing, you must file a written request for a hearing with the 21 Commission within 21 days of the date of this notice.” 2% Mr. Krager did not request a hearing. The Commission, therefore, finds Mr. Krager to be in 24 default and enters the following findings of fact, conclusions of law and order, based on the files 25 and records of the Commission concerning this matter. 26 FINDINGS OF FACT 27 1. Mr. Krager was licensed by the Commission from July 10, 2007 to January 10, 2009, at 28 which time his license expired. There are no current applications for Iicensure on file. 29 2.
