1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the Educator License of ) DEFAULT ORDER OF 5 KELSI LYNN SKINNER ) PUBLIC REPRIMAN D 6 7 8 On December 21, 2012, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing t0 Kelsi Lynn Skinner (Skinner) in which the 10 Commission charged her with Gross Neglect 0f Duty. The Notice was sent via U.S. First Class 1 1 Mail and U.S. Certified Mail Receipt 7011 2000 0001 1292 0127 to the address on file with the 12 Commission. The Notice designated the Commission file as the record for purposes of proving a l3 prima facie case. The Certified Mail receipt was returned t0 the Commission and signed for on 14 December 26, 2012. The regular mail was not returned to the Commission. The Notice of 15 Opportunity of Hearing, dated December 21, 2012, and signed by Victoria Chamberlain, 16 Executive Director, stated: l7 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD, 18 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR 19 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. 20 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A 21 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY‘ 22 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER 23 DISCIPLINE.” 24 25 Skinner did not request a hearing. The Commission, therefore, finds Skinner to be in default and 26 enters the following findings of fact, conclusions of law, and final order, based 0n the files and 27 records of the Commission concerning this matter. 28 FINDINGS OF FACT 29 1. Kelsi Lynn Skinner has been licensed by the Commission since July 20, 2007. Skinner’s 30 Initial I Teaching License, with an endorsement in Advanced Mathematics (HS), was issued 31 August 14, 2012, and expires 0n March 22, 2016. During all relevant times, Skinner was 32 employed by the Jordan Valley School District. 33 2. On May 2, 2012, the Commission received a report alleging Skinner had been teaching without a 34 valid license or registration. The Commission conducted an investigation and learned that Skinner’s 35 Emergency Teaching License had expired on October 1, 2011. Skinner was notified in writing upon 36 issuance of her Emergency Teaching License that there was n0 “Grace period” upon expiration. The 37 Commission’s investigation determined that Skinner had worked for a period 0f approximately six 38 months (October 1, 2011 — April 30, 2012) without a valid teaching license. During the course of 39 Skinner’s licensure history, the Commission granted Skinner a variety of licenses as Skinner worked PAGE 1—DEFAULT ORDER PUBLIC REPRIMAND- SKINNER, KELSI LYNN 1 towards permanent licensure status, including several Restricted Transitional Licenses and 2 Emergency Licenses. With each of these temporary teaching licenses, Skinner was informed 0f any 3 existing time limits, expiration dates, requirements for further licensure, important deadlines, and 4 other information critical to Skinner maintaining proper licensure. Skinner repeatedly failed to 5 meet licensure requirements and thus required multiple Emergency Licenses to remain teaching 6 while Skinner continued to pursue full licensure. Skinner failed to receive an extension of her 7 emergency license, nor did Skinner complete the requirements for full licensure in a timely manner, 8 and Skinner’s Emergency License expired on October 1, 2011. Skinner continued to teach without a . 9 valid license until removed from the classroom on April 3o, 2012.
